AMENDMENT 0002
QUESTIONS & ANSWERS

JILONA SHORELINE STABILIZATION
1. Question: Section L say’s that past performance cannot be greater than 5 years, while section M says that past performance cannot be greater than 3 years, which one is it?
Answer: Section L-9(a) states, “Submit a reference list of no more than five (5) recent and relevant projects.” Section M-2(b)(3)(i) states, “Recent: Recent is defined as a project completed or significantly completed within five (5) years from the issuance date of this solicitation.” Please see corrected RFP of M-5(a) which should have stated, “Projects deemed not recent (greater than five years) will be disregarded.”
2. Question: Are we allowed to use our subs past performance for the past performance on this Project?
Answer: No, past performance should be submitted for the prime only.
3. Question: Is there an engineer’s estimate?
Answer: The government furnished estimate is source selection sensitive and is not releasable. The FAR magnitude for the construction project is over $10M.
4. Question: Please explain the what the information on this sheet means, specifically what is significant about Delivery Date 11/03/2025, and the two Periods of Performance that appear to equal 606 days and 825 days, neither of which equal 634 days shown on Page 1 of 3?
Answer: The entire period of performance is 634 days. The base and some of the option performance periods are overlapping. For example, Option 1 must be completed by November 3, 2024 due to events planned at JILONA after that date. The periods of performance are based on receipt of funding and the estimated completion time for that part of the project.
5. Question: What is the anticipated date (or range of time) that the project will be awarded?
Answer: The government anticipates awarding this prior to the end of fiscal year 2024.
6. Question: What is the anticipated date (or range of time) that the Contractor can commence work onsite?
Answer: Following receipt of performance and payment bonds and insurance and issuance of notice to proceed.
7. Question: Referencing Solicitation, Page 7 of 41, Bid Schedule – Please explain the significance of the dates listed below the Base and all Option Bid Items. And do they represent required OR anticipated performance periods for those phases?
Answer: Those are anticipated performance period dates based on funding and estimated completion for that portion of the project.
8. Question: Please consider allowing the question deadline to extend a minimum of three business days beyond the issuance of the first significant Q&A addendum to allow bidders to provide follow up questions to that addendum. This is a critical step to make sure bidders fully understand the bid requirements.
Answer: There has been one due date established for questions.
9. Question: Referencing Solicitation, Page 7 of 41, Bid Schedule – Please explain the significance of the dates listed below the Base and all Option Bid Items. Are there interim milestones with required performance periods and liquidated damages associated with each Base and Option Item?
Answer: Please see response to question 12. The contract will not include liquidated damages.
10. Question: Is it possible to have our SAM registration reviewed in advance of the bid date to verify that our Certifications and Small Business status are properly submitted?
Answer: That is the responsibility of the offeror to ensure the SAM certifications are correct.
11. Question: Please confirm the Contractor’s Project Manager can be its Quality Control Manager and its Site Superintendent can be its Safety Coordinator.
Answer: See L-9 (c), “qualified individuals may fulfill multiple roles”.
12. Question: Does “ATT_6__Limitations_on_Subcontracting_Breakout” need to be submitted with our bid?
Answer: Yes.
13. Question: Is the project for small business only?
Answer: Yes, this is a total small business set-aside wherein the prime must do 15% of the work.
14. Question: Please clarify or confirm POP dates listed on Form 1442. Is the Base Bid POP from Aug 1, 2024 to Nov 3, 2024? (August 2023 is stated on the Form) Answer: The base is award to November 3, 2025. The periods of performance on the options vary depending on that part of the project. The base work continues to November 3, 2025, since it is expected to take longer. Some option work is overlapping.
15. Question: L9 Volume 3 sub section f. - Past performance can you utilize or incorporate a subcontractor past performance (PPQ or CPAR)?
Answer: Past performance references should be for the prime/offeror.
16. Question: Can we attach the first page of the past performance questionnaire for your reference to section volume 3 for reference and if so, will it count against the page limit?
Answer: Past performance questionnaires should be submitted directly to the Contracting Office. Completed questionnaires submitted by the offeror with the past performance volume will not be considered.
17. Question: The CLIN Option descriptions do not match the work described by the drawings and summary of work for Options 2 to 6 (CLINs 0030 to 0070), will the CLIN descriptions be updated?
Answer: Please see Attachment 9, Statement of Work.
18. Question: Per the solicitation Buy American applies but, the on page 22 of 41 the solicitation appears to determine that WTO GPA and Free Trade Agreements apply to this acquisition.
Answer: Trade Agreements Act is determined not to apply, since a total small business set-aside is one of the exceptions. However, the Buy American Act will apply. See solicitation revision.
