DEPARTMENT OF THE ARMY PERMIT
Permittee: Bureau of Land Management Jupiter Inlet Lighthouse Outstanding Natural Area (ONA) c/o Peter DeWitt 600 State Road 707, Unit B Jupiter, Florida 33469

NOTE: The term "you" and its derivatives, as used in this permit, means the permittee or any future transferee. The term "this office" refers to the appropriate district or division office of the U.S. Army Corps of Engineers (Corps) having jurisdiction over the permitted activity or the appropriate official of that office acting under the authority of the commanding officer.
You are authorized to perform work in accordance with the terms and conditions specified below.
Project Description: The applicant seeks authorization to construct a living shoreline restoration project that also promotes public utilization of the area along approximately 3,500 linear feet of shoreline. The project would construct a dock, boardwalk, breakwaters and stone revetments, a retaining wall, riprap placement, and wetland planters, as well as regrade a portion of the shoreline to create a beach area and install a kayak launch. The project includes upland work associated with constructing upland walking paths and upland outdoor facilities including a pavilion. Specifically, the applicant is proposing to conduct the following activities:
Off-shore/In-water features:
1. The placement of 2,685 cubic yards of clean fill material such as limestone, granite, concrete or similar within a 0.58-acre area in a series of 21 nearshore breakwater structures and crest elevation(s) of +2.5 feet (NAVD88).
2. The placement of 1,260 cubic yards/0.49-acres of armor stone across 1,083 linear feet in a series of six (6) stone revetments below the high tide line (HTL).
Of the total, 1,162 cubic yards/0.42-acres will be placed below the mean high water line (MHWL).
3. The placement of 1,426 cubic yards/0.35-acres of armor stone along 677 linear feet of shoreline for three stone sills below the HTL. Of the total, 1,375 cubic yards/0.29-acres will be placed below the MHWL.
4. Installation of 13,609 square feet/ 0.31-acres native plantings of mangroves and wetland vegetation landward of the breakwaters, revetments, and sills.

5. Installation of 34 timber pilings between breakwaters to allow for optimal restoration of plantings.
6. Installation of six (6) timber pilings along the southern shoreline to serve as navigational aids.
7. Installation of a 1,228 square foot floating dock that contains a 54 ft Americans with Disabilities Act (ADA) compliant gangway, a 60-foot by 10-foot access walkway, a 8-foot by 62-foot terminal platform, a 8-foot by 28-foot landing, and one (1) boatlift. The dock will have a total of four (4) slips for USCG, where three
(3) of the slips will be utilized by law enforcement.
8. Removal of existing piles
9. Installation of a fixed 715 linear foot (7,592 square foot) boardwalk which varies in width from 8 to 16 ft, consisting of open grated decking. Of the total, 568 linear foot/0.13-acres will be below MHWL with installation of 140 10-in pilings.
10. Installation of two (2) SeaHive experimental stabilization structures and five (5) 10-inch composite pilings for the installation of Ecodisk artificial reef systems
On-shore/Above MHWL features:
11. Installation of two 831 linear foot retaining wall, as well as beach access points and kayak launches for public access.
12. Installation of approximately 1,902 square foot/0.04 acres of vegetation removal and grading to create an expanded beach area adjacent to S. Beach Road Bridge.
13. Installation of approximately 11,930 square foot/0.27-acres of native planting (typical hardwood hammock species) on and above the retaining wall terraces.
Upland Activities:
14. Installation of approximately 923 linear feet of railed/fence pathway connecting separated seven (7) staircases along the terrace providing connection to shoreline elements from existing pathways.
15. Installation of approximately 430 linear feet of concrete ADA-accessible pathway connecting the existing pedestrian pier with the pavilion and existing ADA-accessible pathways.
16. Installation of approximately 180 linear feet of improved trail to provide access to the shoreline.
17. Renovation and expansion of an existing pavilion from 270 square feet to 740 square feet (including installation of electrical and water services).
The project includes the placement of 5,648 cubic yards of material within waters of the United States. There will be 61,558 square feet of direct effects to the substrate as a result of the installation of the breakwaters, rock sills and revetments. Additionally, there will also be approximately 6,716 square feet of overwater shading in total, where 5,488 square feet overwater will be elevated 8 feet above MHW with open grated decking and 1,228 square feet overwater will be the floating dock.
The work described above is to be completed in accordance with the 14 pages of drawings [and 10 attachments] affixed at the end of this permit instrument.
Project Location: The project would affect waters of the United States associated with the shoreline of the Intracoastal Waterway and segments of shoreline along the Indian River Lagoon and the Loxahatchee River. The project site is located adjacent to 500 Captain Armours Way in Section 31, Township 40 South, Range 43 East, Jupiter, Palm Beach County, Florida.
Directions to site:
From I-95 take exit 87A, turn left onto Center Street and continue for 2.3 miles. Turn left onto FL-811 North/Florida A1A Alt North. Continue straight onto South Beach Road.
Turn right onto Captains Armours Way, turn left and continue onto Captain Armours Way. Turn right and arrive at Jupiter Inlet Lighthouse Outstanding Natural Area.

Permit Conditions
General Conditions:
1. The time limit for completing the work authorized ends on ____________. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and State coordination
July 23, 2029 required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places.
4. If you sell the property associated with this permit, you must obtain the signature and the mailing address of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions (Attached).
6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.
Special Conditions:
1. Reporting Address: The Permittee shall submit all reports, notifications, documentation and correspondence required by the general and special conditions of this permit to either (not both) of the following addresses:
a. For electronic mail (preferred): SAJ-RD-Enforcement@usace.army.mil (not to exceed 15 MB).
b. For standard mail: U.S. Army Corps of Engineers, Regulatory Division, Enforcement Section, P.O. Box 4970, Jacksonville, Florida 32232-0019.
The Permittee shall reference this permit number, SAJ-2019-01674 (SP-KMM), on all submittals.
2. Commencement Notification: Within 10 days from the date of initiating the work authorized by this permit the Permittee shall submit a completed “Commencement Notification” Form (Attachment 2).
3. Permit Conditions Prevail: If information in the permit attachments conflict with the special conditions of this permit, the requirements of the permit special conditions shall prevail.
4. Posting of Permit: The Permittee shall have available and maintain for review a copy of this permit and approved plans at the construction site.
5. As-Built Certification with X-Y Coordinates: Within 60 days of completion of the authorized work or at the expiration of the construction window of this permit, whichever occurs first, the Permittee shall submit as-built drawings of the authorized work and complete the enclosed “As-Built Certification by Professional Engineer or Surveyor” form, (Attachment 3) to the Corps. The drawings shall be signed and sealed by a registered professional engineer or a professional land surveyor confirming the actual location of all authorized work/structures with respect to the Federal channel and/or within the Federal easement and include the following:
a. A plan view drawing of the location of the authorized work footprint (as shown on the permit drawings) with an overlay of the work as constructed in the same scale as the attached permit drawings (8½-inch by 11-inch).
The drawings shall include the X & Y State Plane coordination points of the most waterward point of the structure. The drawings shall include the dimensions of the structure, location of mean high water line (MHWL), depth of water (at mean low water) at the waterward end of the structure, and the distance from the waterward end of the structure to the near design edge of the Federal channel.
b. List of any deviations between the work authorized by this permit and the work as constructed. In the event the completed work deviates, in any manner, from the authorized work, describe on the As-Built Certification Form the deviations between the work authorized by this permit and the work as constructed. Clearly indicate on the as-built drawings any deviations that have been listed. Please note the depiction and/or description of any deviations on the drawings and/or As-Built Certification Form does not constitute approval of any deviations by the Corps.
c. The Department of the Army Permit number.
d. Within 60 days of completion of the work authorized by this permit, the Permittee shall provide a courtesy copy of the signed and sealed As-Built drawings to the Corps, Engineering Division. Submittals shall be sent either electronically by email at ENPermits.CESAJ@usace.army.mil or by standard mail at Post Office Box 4970, Jacksonville Florida 32232-0019.
6. Assurance of Navigation and Maintenance: The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structures or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.
7. Fill Material: The Permittee shall use only clean fill material for this project. The fill material shall be free from items such as trash, debris, automotive parts, asphalt, construction materials, concrete block with exposed reinforcement bars, and soils contaminated with any toxic substance in toxic amounts, in accordance with Section 307 of the Clean Water Act.
8. Turbidity Barriers: Prior to the initiation of any of the work authorized by this permit, the Permittee shall install floating turbidity barriers with weighted skirts that extend within 1 foot of the bottom around all work areas that are in, or adjacent to, surface waters. The turbidity barriers shall remain in place and be maintained daily until the authorized work has been completed and turbidity within the construction area has returned to ambient levels. Turbidity barriers shall be removed upon stabilization of the work area.
9. Erosion Control: Prior to the initiation of any work authorized by this permit, the Permittee shall install erosion control measures along the perimeter of all work areas to prevent the displacement of fill material outside the work area into waters of the United States. The erosion control measures shall remain in place and be maintained until all authorized work is completed and the work areas are stabilized.
10. Cultural Resources/Historic Properties:
a. No structure or work shall adversely affect impact or disturb properties listed in the National Register of Historic Places (NRHP) or those eligible for inclusion in the NRHP.
b. If, during permitted activities, items that may have historic or archaeological origin are observed the Permittee shall immediately cease all activities adjacent to the discovery that may result in the destruction of these resources and shall prevent his/her employees from further removing, or otherwise damaging, such resources. The applicant shall notify both the Florida Department of State, Division of Historical Resources, Compliance Review Section at (850)-245-6333 and the Corps, of the observations within the same business day (8 hours). Examples of submerged historical, archaeological or cultural resources include shipwrecks, shipwreck debris fields (such as steam engine parts, or wood planks and beams), anchors, ballast rock, concreted iron objects, concentrations of coal, prehistoric watercraft (such as log "dugouts"), and other evidence of human activity. The materials may be deeply buried in sediment, resting in shallow sediments or above them, or protruding into water. The Corps shall coordinate with the Florida State Historic Preservation Officer (SHPO) to assess the significance of the discovery and devise appropriate actions. Project activities shall not resume without verbal and/or written authorization from the Corps.
c. Additional cultural resources assessments may be required of the permit area in the case of unanticipated discoveries as referenced in accordance with the above Special Condition and, if deemed necessary by the SHPO or Corps, in accordance with 36 CFR 800 or 33 CFR 325, Appendix C (5).
Based on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend, or revoke the permit in accordance with 33 CFR Part 325.7. Such activity shall not resume on non-federal lands without written authorization from the SHPO for finds under his or her jurisdiction, and from the Corps.
d. A professional archaeologist who meets the "Archaeology and Historic Preservation: Secretary of Interior’s Standards and Guidelines” shall be onsite during any ground-disturbing activities within the monitoring area as represented in Attachment 4: “SAJ 2019-01674 Special Conditions Map” specifically the “Archaeology Monitoring Area” of the map. The professional archaeologist shall be responsible for monitoring the soils for significant archaeological deposits. The archaeological monitor shall have the authority to stop construction activities within the monitored areas in order to inspect and assess soil deposits for archaeological resources.
Should potential, significant archaeological deposits be encountered, all work and ground disturbing activities must cease within a 30-meter diameter of the discovery to allow for proper assessment, recording, and recovery of the cultural deposits in a professional manner. The monitor shall have a bioarchaeologist or other qualified “skeletal analyst” as defined in Florida statute 872.05, section (2)(d) qualified in identifying human remains, available on-call for assessment of any suspected human skeletal elements. If the archaeological monitor is unable to identify if observed bones are of non-human origin then the permitted activity must halt until the bioarchaeologist makes an assessment. The archaeologist on site shall notify the Permittee, SHPO, and the Corps the same business day (8-hours) to assess the significance of archaeological discoveries and devise appropriate actions, including salvage operations if appropriate. Upon completion of the monitoring activities, an archaeological monitoring letter must be submitted to Florida’s Division of Historical Resources and the Corps, along with an updated Florida Master Site File form.
e. If the event that human remains are encountered on federal or tribal lands, or in situations where the Archaeological Resources Protection Act of 1979 or the Native American Graves Protection Repatriation Act of 1990 applies, all work and ground disturbing activities within a 50-meter diameter of the unmarked human remains shall immediately cease and the Permittee shall immediately notify the Corps, within the same business day (8-hours). The Corps shall then notify the appropriate THPO(s) and SHPO. Based on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend, or revoke the permit in accordance with 33 CFR Part 325.7. After such notification, project activities on federal lands shall not resume without written authorization from the Corps, and/or appropriate THPO(s), SHPO, and federal manager. After such notification, project activities on tribal lands shall not resume without written authorization from the appropriate THPO(s) and the Corps.
f. The applicant, as a Federal agency, must have a NAGPRA Plan of Action or an Unanticipated Discovery of Human Remains plan in place prior to ground disturbing activities.
g. Prior to construction activities, contractors performing the work shall be made aware of the possibility of encountering cultural resources/burial resources and told what procedures to follow if resources are found.
h. All heavy equipment operation and staging activities must avoid inadvertent, subsurface impacts within the “Archaeological Monitoring Area” as shown in the attached Special Conditions map. The contractor shall provide protective ground cover, geo-matting or comparable, to protect 8PB35 from ground disturbance related to storage of construction material and operation of heavy equipment.
11. Consent to Easement: A portion of the authorized work may be located within the Federal right-of-way and therefore, may require a Department of the Army Consent to Easement. The Permittee shall complete the “Application for Consent to Cross U.S. Government Easement” (Attachment 5) and submit to the Corps Real Estate Division SAJ-RE-Consent@usace.army.mil or Post Office Box 4970, Jacksonville, Florida 32232-0019 or by telephone at 904-570-4514. The application should include a boundary survey map along with the authorized construction plans and specifications for the project. Prior to commencement of construction, the Permittee shall provide a copy of the Corps approved Consent to Easement, or correspondence from the Real Estate Division indicating that a Consent to Easement is not required, to the address identified in the Reporting Address Special Condition.
12. Federal Channel Setback: The most waterward edge of the authorized dock structure shall be constructed no closer than 32.5 feet from the near design edge of the federal channel as shown in the attached drawings. While all other structures shall be constructed landward of the 62.5 feet from the near edge of the federal channel as shown in the attached drawings and Attachment 6 “Navigation Measurements”.
13. Notice of Permit: The Permittee shall complete and record the “Notice of Department of the Army Authorization” form (Attachment 7) with the Clerk of the County Court, Registrar of Deeds or other appropriate official charged with the responsibility of maintaining records of title to or interest in real property within the county of the authorized activity. No later than 90 days from the effective date of this permit, the Permittee shall provide a copy of the recorded Notice of Permit to the Corps clearly showing a stamp from the appropriate official indicating the book and page at which the Notice of Permit is recorded in the official records and the date of recording.
14. Individual Section 408 Approval: It has been determined that the activities authorized do not impair the usefulness of the Intracoastal Waterway/Loxahatchee River and are not injurious to the public interest. The Permittee shall adhere to the conditions and limitations referenced in the Section 408 approval memo, 408-SAJ-2024-0052 in Attachment 8 of this permit. All documentation required in the Section 408 approval memo, including Appendix K shall be submitted either electronically by email at ENPermits.CESAJ@usace.army.mil or by standard mail at Post Office Box 4970, Jacksonville Florida 32232-0019. For all questions related to the Section 408 approval, contact the Corps, Jacksonville Engineering Division by telephone at 904-232-1604. Engineering Division is the appropriate authority to determine compliance with the terms and conditions of Section 408 approval.
15. Special Aquatic Site Boundary Identification: Prior to the initiation of any authorized work, the Permittee shall stake the edges of the existing submerged aquatic vegetation (SAV), every 10 feet to ensure the special aquatic site boundary is visible to all construction personnel to prevent encroachment and impacts to these sensitive areas.
16. Work Vessel Anchoring: Drawings identify the location of submerged aquatic vegetation and mangroves documented at the project site. This permit does not authorize construction work vessels anchoring or spudding down in areas where submerged aquatic vegetation and mangroves are present.
17. Manatee Conditions: The Permittee shall comply with the “Standard Manatee Conditions for In-Water Work – 2011” (Attachment 9). The most recent version of the Manatee Conditions must be utilized.
18. Mantee Education Sign: The applicant shall install and maintain permanent manatee educational signs for areas that provide watercraft access. Signs must be posted in a visible location(s) alerting users of the species susceptibility to vessel strikes. The manatee educational materials shall be in accordance with the Florida Fish and Wildlife Conservation Commission at https://myfwc.com/wildlifehabitats/wildlife/manatee/education-for-marinas/
19. Jacksonville District Programmatic Biological Opinion (JAXBO): Structures and activities authorized under this permit will be constructed and operated in accordance with all applicable PDCs contained in the JAXBO, based on the permitted activity. Johnson’s seagrass and its critical habitat were delisted from the Endangered Species Act on May 16, 2022. Therefore, JAXBO PDCs required to minimize adverse effects to Johnson’s seagrass and its critical habitat are no longer applicable to any project. Failure to comply with applicable PDCs will constitute noncompliance with this permit. In addition, failure to comply with the applicable PDCs, where a take of listed species occurs, would constitute an unauthorized take. The NMFS is the appropriate authority to determine compliance with the Endangered Species Act. The most current version of JAXBO can be accessed at the Jacksonville District Regulatory Division website in the Endangered Species section of the Sourcebook located at:

JAXBO may be subject to revision at any time. The most recent version of the JAXBO must be utilized during the design and construction of the permitted work.
20. Eastern Indigo Snake Protection Measures and Inspection: Permittee shall comply with U.S. Fish and Wildlife Service's “Standard Protection Measures for the Eastern Indigo Snake” dated March 23, 2021, as provided in Attachment 10 of this permit. All gopher tortoise burrows, active or inactive, shall be evacuated prior to site manipulation in the vicinity of the burrow. If excavating potentially occupied burrows, active or inactive, individuals must first obtain state authorization via a Florida Fish and Wildlife Conservation Commission (FWC) Authorized Gopher Tortoise Agent permit. The excavation method selected shall minimize the potential for injury of an indigo snake. The Permittee shall follow the excavation guidance provided in the most current FWC Gopher Tortoise Permitting Guidelines found at http://myfwc.com/gophertortoise. If an indigo snake is encountered, the snake must be allowed to vacate the area prior to additional site manipulation in the vicinity. Holes, cavities, and snake refugia other than gopher tortoise burrows shall be inspected each morning before planned site manipulation of a particular area, and if occupied by an indigo snake, no work shall commence until the snake has vacated the vicinity of the proposed work.
21. Monitoring and Reporting Timeframes: The Permittee shall submit all monitoring reports to both:
The Corps at the address indicated in Special Condition #1, and to:
The NMFS, Habitat Conservation Division (HCD) by email at Xaymara.Serrano@noaa.gov or by mail at
NMFS, Habitat Conservation Division 400 North Congress Avenue, Suite 270 West Palm Beach, Florida 33401.
22. Monitoring and Reporting Requirements: To ensure the wetland plantings are successful and that the structures and/or fill placed in-water would continue to perform as expected, the Permittee shall comply with the following monitoring and reporting requirements:

a. Perform a time-zero monitoring event of the planted mangroves and saltmarsh vegetation, and the breakwaters within 60 days of completion of the shoreline work.
b. Submit the time-zero report to the Corps and NMFS, HCD no later than 60 days after completion of the monitoring event. The report will include at least one paragraph depicting baseline conditions of the site(s).
c. Perform semi-annual monitoring of the planted areas and the function of the shoreline structures for the first 2 years and annual monitoring thereafter for a total of no less than 5 years of monitoring.
d. Submit annual monitoring reports to the Corps and NMFS, HCD no later than 60 days after completion of the final monitoring event for that year.
Semi-annual monitoring will be combined into one annual monitoring report.
e. Monitor the plantings and function of the shoreline structures, and submit annual monitoring reports to the Corps and NMFS, HCD until released by the Corps.
23. Reporting Format: The Permittee shall submit monitoring reports to the Corps, which must include the following:
1. Project Overview:
a. Department of the Army Permit Number;
b. Name and contact information for the Permittee and authorized consultant;
c. Name of the party responsible for conducting the monitoring and the date(s) the inspection was conducted;
d. A brief paragraph describing the purpose of the approved project, acreage, type of aquatic resources impacted, and type and acreage of resources authorized;
e. Short statement of whether the performance of the structures and wetland areas are being met;
f. Dates and details of any recent corrective or maintenance activities conducted since the submittal of the previous report; and
g. Specific recommendations for any additional corrective or remedial actions.
2. Requirements: List the monitoring requirements, as specified in the special conditions of this permit, and evaluate whether the project site is successfully achieving the anticipated performance standards or trending towards success.
3. Summary Data: Summary data should be provided to substantiate the success and/or potential challenges associated with the plantings. Photo documentation may be provided to support the findings and recommendations referenced in the monitoring report and to assist the Corps project manager in assessing whether the project is meeting applicable performance standards for that monitoring period. Submitted photos should be dated and clearly labeled with the direction from which the photo was taken. The photo location points should also be identified on the appropriate maps.
4. Maps and Plans: Maps shall be provided to show the location of the planting site(s) and the in-water structures relative to other landscape features, habitat types and acreages, locations of photographic reference points, transects, sampling data points, monitoring wells, and/or other features pertinent to the mitigation plan. In addition, the submitted maps and plans shall clearly delineate the mitigation site perimeter(s). Each map or diagram shall include a legend and the location of any photos submitted for review. As-built plans shall be included as required by As-Built Certification with X-Y Coordinates Special Condition.
5. Conclusions: A general statement shall be included that describes the current conditions of the project. If performance is not being achieved, a brief explanation of the difficulties and potential remedial actions proposed by the Permittee or sponsor, including a timetable, shall be provided. The District Engineer will ultimately determine if the project is successful for a given monitoring period.
24. In-Water Work: To minimize the amount of earth disturbance with the uplands, the Permittee shall conduct in-water work from the water, as possible.
25. Work from the Water: All work along the bluff and shoreline area shown in the attached “Special Conditions Map” shall be performed from barges in the water.
If certain activities cannot be performed from barges then all the conditions in the above Cultural Resources section shall apply to the work performed from land.
26. Sufficient Depths of Vessels: The Permittee agrees that all vessels shall operate within waters of sufficient depth (one-foot clearance from the deepest draft of the vessel to the top of submerged resources or submerged bottom, whichever is less) in a manner to preclude bottom scarring, prop dredging, or damage to the submerged resource or bottom.
27. Adaptive Management: In the event that organisms became entrapped or caught landward of the breakwaters or revetments, then corrective action such as including more gaps will need to be modified.

2. Limits of this authorization.
a. This permit does not obviate the need to obtain other Federal, State, or local authorizations required by law.
b. This permit does not grant any property rights or exclusive privileges.
c. This permit does not authorize any injury to the property or rights of others.
d. This permit does not authorize interference with any existing or proposed Federal projects.
3. Limits of Federal Liability. In issuing this permit, the Federal Government does not assume any liability for the following:
a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of current or future activities undertaken by or on behalf of the United States in the public interest.
c. Damages to persons, property, or to other permitted or unpermitted activities or structures caused by the activity authorized by this permit.
d. Design or construction deficiencies associated with the permitted work.
e. Damage claims associated with any future modification, suspension, or revocation of this permit.
4. Reliance on Applicant's Data: The determination of this office that issuance of this permit is not contrary to the public interest was made in reliance on the information you provided.
5. Reevaluation of Permit Decision: This office may reevaluate its decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following:
a. You fail to comply with the terms and conditions of this permit.
b. The information provided by you in support of your permit application proves to have been false, incomplete, or inaccurate (see 4 above).
c. Significant new information surfaces which this office did not consider in reaching the original public interest decision.
Such a reevaluation may result in a determination that it is appropriate to use the suspension, modification, and revocation procedures contained in 33 CFR 325.7 or enforcement procedures such as those contained in 33 CFR 326.4 and 326.5. The referenced enforcement procedures provide for the issuance of an administrative order requiring you comply with the terms and conditions of your permit and for the initiation of legal action where appropriate. You will be required to pay for any corrective measures ordered by this office, and if you fail to comply with such directive, this office may in certain situations (such as those specified in 33 CFR 209.170) accomplish the corrective measures by contract or otherwise and bill you for the cost.
6. Extensions: General Condition 1 establishes a time limit for the completion of the activity authorized by this permit. Unless there are circumstances requiring either a prompt completion of the authorized activity or a reevaluation of the public interest decision, the Corps will normally give favorable consideration to a request for an extension of this time limit.
