This solicitation is for a firm fixed construction for the following project: This is a fair opportunity, contractor is to provide all materials, supplies, incidentals, labor, equipment, and supervision necessary to provide design build construction services for the Lecture Hall in accordance with the statement of work for Haskell Indian Nations University (HINU), in Lawrence, Kansas.
1. A single firm fixed price construction contract will be issued using this solicitation.

10. Notice to Proceed (NTP): A Notice to
Proceed (NTP) will be issued after the
Pre-Construction meeting, Receipt of Bonding and
Valid Background Screening.
11. Period of Performance: Three Hundred sixty-five (365) Calendar Days from notice to proceed.
12. In accordance with FAR Part 36.204(e) Disclosure of the Magnitude of Construction
Projects estimated price range is between$500,000.00 and $1,000,000.00.
13. BONDS (Reference Contract Clause FAR 52.228-15 for further information on applicability): A bid bond is due at the time of proposal submittal. And the payment and performance bond shall be provided 10 calendars after receipt of the award of the Task order.
Notice to proceed will not be issued until the

15. An award is being competed using the Lowest Price Technically Acceptable source selection process described in Section L & M. B.1 REQUIRED WORK
The proposed work consists of the contractor shall provide all labor, materials, transportation, supervision, and incidentals necessary for Design-Build Services for a base bid to convert room 118 in Parker Hall into a Lecture Hall in Parker Hall building (Blg.112) and an OPTIONAL Bid item to provide and install a fire alarm system for the building at Haskell Indian Nations University (HINU) in Lawrence, Kansas, in the accordance with the Statement of Work.
Period of Performance: (365) calendar days from the issuance of the Notice to Proceed.

Miscellaneous Work: The contractor shall not perform any of contingent sum work, until the Contracting Officer issues a contract modification authorizing performance of work in accordance with FAR Clause 52.243-4, Changes; and subject to availability of funds, FAR Clause 52.232-18, Availability of Funds.
The Contractor shall promptly notify the Contracting Officer, in writing, of subsurface or any physical conditions different from those indicated in this contract or unknown unusual physical conditions at the site before proceeding with the work. The change orders request shall be forwarded to the Contracting Officer by memorandum outlining the need and a justification for the change order. Upon receipt of a change order request, the Contracting Officer will request a cost proposal from the Contractor. All cost proposals shall be in detail and itemized, showing price breakdown in sufficient detail to permit an analysis of cost for material, labor, equipment, hours, taxes, insurance, bonds, overhead costs, profit, and complete description of work involved in the change order, including any time extension.
In an emergency, a telephone approval may be granted by the Contracting Officer, and immediately the Contractor shall follow through by submitting a written cost proposal to the Contracting Officer.

A. GENERAL
1. Purpose:
Haskell Indian Nations University is requesting proposals from a qualified Contractors to provide a for Design-build services for a base bid to convert room 118 in Parker Hall into a Lecture Hall in Parker Hall building (Blg.112) and an option bid item to provide and install a fire alarm system for the building. The Contractor shall provide all services required including, but not limited to, design, selective demolition, roofing, general construction, and supervision to accomplish the tasks in accordance with this statement of work, contract terms, conditions, specifications, and any special requirements. Follow NFPA 5000 and all applicable codes for architectural, structural, mechanical, electrical, and other codes as determined by BIA /BIE. Refer to Codes and Standards below.
2. Project Location: Building 112, Parker Hall, built circa 1966 Haskell Indian Nations University located in Lawrence, Kansas.
3. The following specifications/guidelines shall be utilized work described.
Definitions and Acronyms:
“ADAABAAG” means “Americans with Disabilities Act and Architectural Barriers Act Accessibility Guidelines”.
“A/E” refers to a qualified and licensed Architect and/or Engineer “AHJ” refers to the Authority Having Jurisdiction “BIA” refers to the Bureau of Indian Affairs.
“BIE” refers to the Bureau of Indian Education.
“CO” refers to the BIA or BIE Contracting Officer.
“COR” refers to the Contracting Officer’s Representative.
“Design Handbook” refers to the latest published edition of the BIA School Facilities Design Handbook.
“DOI” refers to the U.S. Dept. of the Interior.
“DSRM” refers to the “Division of Safety and Risk Management” which is the AHJ and located in Albuquerque, NM.
“FM” refers to Factory Mutual approval standards.
“HINU” refers to Haskell Indian Nations University, located in Lawrence, Kansas.
“Plan Review Procedure” refers to the May 2020 edition, “Safety, Health and Accessibility Design Guidelines for Architects, Engineers and Design Firms”.
“SOW” refers to Statement of Work.
“UL” refers to Underwriters Laboratories.
B. CODES AND STANDARDS
The Contractor shall provide a multi-disciplined team to furnish services required to complete the work. Each responsible team member must be knowledgeable of and provide work in compliance with the latest published editions of all applicable codes, standards, design handbooks, plan review procedures, and guidelines as adopted by BIA /BIE which include but may not be limited to:

Where applicable, the Contractor shall adhere to all federal and state statutes pertaining to archaeological, historical, and environmental clearances which may affect this project. Strict adherence to the National Environmental Protection Act (NEPA) and the National Historic Preservation Act (NHPA), Section 106, will be mandatory.
Haskell Indian Nations University utilizes an Environmental Management System (EMS) to follow regulations concerning environmental laws. The Contractor shall follow all applicable environmental laws.
C. SCOPE OF WORK
1. At the discretion of the Contracting Officer, a mandatory Pre-Bid Proposal Conference may be scheduled. The Bidders shall attend this informational meeting on site at HINU. The Contracting Officer will notify the Bidders via the Solicitation Amendment process, of the date and time of this meeting. Bidders shall bear all cost of preparing their proposal including any site visit, pre-bid conference or site investigations prepared prior to submitting their bids.
2. Meet on-site with HINU staff as directed by the HINU Facilities Manager and /or COR to discuss specific requirements.
3. Concept drawings for the base bid requirements are attached to this SOW intended for general presentation only and some systems may not be presented in detail in the drawings. Bidders and awarded Contractor are responsible for verifying all dimensions, systems, existing conditions….etc, and all requirements of the new work to achieve the goal of turning room 118 into a Lecture Hall and provide a storage room with the most recent published code versions required at the time of the RFP issuance.
4. The bidders shall request existing facility drawings, records, reports, and other relevant building information that may be available. Existing building documentation provided is for informational purposes only. It is the responsibility of the bidders to field verify the completeness and accuracy of the information requested.
5. Contractor shall locate, inspect, and determine capacity of any site conditions, architectural, structural, mechanical, electrical, and plumbing that will be affected by construction operations. Verify all existing building conditions, utilities, finishes, dimensions, and clearances impacted by the work. Contractor shall notify COR of any deficiencies or suspected hazardous materials encountered.
6. The Contractor shall verify and provide the quantity of labor and materials required to complete the work.
7. Several buildings on the HINU campus are listed in the Historical Register. The Contractor shall confirm the historical status of each building where work is to be performed. Where listed on the Historical Register, the design and materials utilized will be subject to review by the historical authorities having jurisdiction.
8. All contractors, sub-contractors, and suppliers shall abide by all COVID protocols currently in effect while on campus.
9. Contractor to provide PPE as required.
10. Applicable life safety and accessibility components of the project or attachment to, such as structural, fire alarm, fire suppression, ADAABAAG requirements, etc. are subject to DSRM review.
11. All damages to Haskell Indian Nations University facilities due to destructive investigation, demolition, construction, or staging operations shall be the Contractor’s responsibility to repair.
12. The Contractor shall provide their own dumpster for removed materials and identify all removed materials that are suitable for recycling. In addition, the contractor shall provide their own temporary restroom facilities and hand washing stations on-site.
13. All waste materials shall be removed and disposed of in a manner in accordance with local, State, and Federal regulations.
14. The Contractor shall make areas safe during demolition and construction phases using safety tools such as roof edge protection, cones, snow fencing, ribbon tape, and barricades to keep student, staff, workers, and public safe. Submit location of staging areas to COR for review.
15. This facility may be in use during the Period of Performance (POP). Schedule any utility outages and building closings with the COR.

16. The building may be occupied during the construction period. Install protective temporary partitions, plastic sheeting, etc. as required to protect areas of the building not part of the work. Utilize low /zero VOC materials to minimize vapors. Any paints or coatings utilized in the project shall be no VOC content type.
17. All components and other materials utilized, shall conform to all applicable testing standards, as well as fire rating per NFPA and other applicable code requirements for the occupancy of the space. Include all seismic mounting requirements per applicable code.
18. The Contractor shall provide a copy of the organization’s safety program to the COR after award of contract.
19. Contractor shall provide 1-year warranty for all construction work from the date of acceptance including materials and labor in addition to the standard manufacturer’s warranty for all installed and supplied systems.
20. Design/Build Requirements:
a. The Contractor shall meet with the COR and designated HINU staff to review the work to be performed.
b. The Contractor shall locate, inspect, determine suitability, capacity, and all other conditions of the existing building that will be affected by the installation of a new Lecture Hall.
c. The Contractor shall provide the design in accordance with BIA School Facilities Design Guidebook procedure for the work under this project for approval. No construction to start for any portion of the work until the design of that portion is approved by the Government.
d. Contractor to incorporate in its design and construction all applicable Federal and state requirements and permits required and such compliance and permitting cost to be inclusive in the project award price.
e. D-B Contractor shall carefully consider scheduling the design work and lead time for acquiring materials, equipment and systems when submitting its proposal. Contractor assumes all responsibility to meet the proposed schedule.
21. Additional Project Requirements:
a. This work shall be performed by a qualified contractor with a minimum of 7 years of experience in commercial construction, preferably on university campus buildings with Lecture Halls construction experience.
b. All materials utilized and work performed shall follow all applicable codes and standards. The installation shall be done in a quality workmanship -like manner.
c. The Contractor shall be certified by the roofing manufacturer as an authorized installer/repairer to perform such work so as not to cancel any roof warranty.
d. The contractor shall provide training for HINU staff for each system installed. Submit a training schedule and materials 14 days prior to the scheduled date.
e. Salvage and reinstall all devices or equipment interfering with the new installation as required to complete the project. Notify COR of any damaged or non-functional equipment encountered.
f. If mechanical, electrical, plumbing, or other system serving the building is interrupted for an extended period greater than 48 hours, then the Contractor shall provide temporary service to the building for the duration of the interruption.
g. The Contractor shall furnish all equipment, tools, scaffolding, lifts, crane, shoring, safety gear, etc. as required to perform the work.
D. TASK DESCRIPTION
The following item numbers shall be priced separately and as a total.
The Government reserves the right to accept any or all contract line-item numbers. See other sections of this Statement of Work (SOW) for additional requirements.

Lecture Hall in room 118 of Parker Hall building. HINU desires 60 students to be accommodated in the Lecture
Mountain School
Hall. The work will include retrofitting of the room finishes, furniture, and systems to achieve the functionality required for the lecture hall.
c. The Contractor shall verify the existing building conditions.
d. Concept drawings for the base bid requirements are attached to this SOW intended for general presentation only and some systems may not be presented in detail in the drawings. Bidders and awarded Contractor are responsible for verifying all dimensions, systems, existing conditions….etc, and all requirements of the new work to achieve the goal of turning room 118 into a Lecture Hall and provide a storage room with the most recent code versions required at the time of the RFP issuance.
e. Room 118 has been currently renovated as part of another project except for the floor whereas it has no floor installed over the existing concrete slab.
f. Demolish the concrete slab at the porch with the stair and construct a new concrete slab, stair, and ADA ramp for the new entrance of the Lecture Hall. Install new aluminum 2 pipe hand railing system. Coordinate the desired handrail color with the COR.
g. Demolish the existing aluminum door and door frame with all hardware at room 118 entrance. Infill the exterior wall with same wall materials to include wall structure, insulation, and finishing; match existing exterior finish.
h. Selectively demolish part of the north wall (Approximately 10’ x 10’ and install new storefront system with aluminum double door 3’ x 7’ each leaf. The system shall be energy efficient. Doors to include all hardware, stoppers, security locking systems interfacing with the building security system and ADA access requirement.
i. Install a new metal canopy at the porch to cover the entire slab. Design shall consider the Indian Nations Cultural art for the canopy.
j. Remove all doors and door frames leading to the offices at the west wall. Infill the opening with same wall materials, patch and repair the damaged areas of the wall.
k. The lecture hall will require additional storage facility. Contractor to convert one of the rooms at the west wall side into a storage room. It is proposed that room 112 and 114 to be served for a storage and service area whereas a new mechanical room to be installed. Contractor to investigate the adequacy of the government proposed arrangement or to propose a new configuration or another room to be used for this purpose. Contractor to perform all selective demolition for walls, doors, ceiling, electric, ductwork, …etc. to accommodate the contractor’s approved configuration design. Contractor to construct new partitions, install new doors, power, reconfigure the lighting, ceiling, diffusers, grilles, ductwork, …etc. for the room selected to serve as the mechanical room and storage area.
l. Demolish the existing mechanical room walls, door and door frames entirely. Patch and repair wall affected by the demolition. The existing mechanical room is located in room 118 at the northeast corner of the room.
m. Construct a new mechanical room including partition walls, flooring, metal access double door, ceiling if required in a new location in accordance with the contractor’s approved design. The proposed location is inside the current room 112 as shown in the concept drawings. contractor to verify adequacy and code compliance of the proposed new location.
n. Construct a new floor tiers to shape floor staging for the student’s seating suitable for a lecture hall. Contractor to design the structure and flooring deck.
o. Supply and install carpet flooring system with a resilient wall base for room 118. Carpet flooring system to be adequate for heavy passage and Lecture Hall requirements.
p. Demolish the existing ceiling and all associated lighting, power system, instruments, and HVAC system. Salvage and deliver to the Government projector and all ceiling mounted useable system. Salvage all conduits, junction boxes for possible reuse in the new construction. Salvage the skylight structure for reinstallation after the new ceiling installed. Paint and repair or replace to the COR satisfaction any damaged part of the skylight structure and components affected during removal.
q. Install new ceiling system in compliance with the acoustical properties required for lecture halls. The ceiling proposed is a boundary soffit 4’ wide and 2’x2’ acoustical suspended ceiling system in the center as shown in the concept drawings. re-install new the skylight system structure attached to the ceiling. Provide new remote controlled automatic dimming system for skylights so that light is reduced to levels that will not impede using the new audio/video equipment. Repair, paint or replace any damaged part of the skylight structure affected during removal.
r. Supply and install new acoustical wall system. Acoustical wall panels to have decorative wood pattern at the south
Mountain School and north walls and solid fabric finishing at the east and west walls. Pattern and colors to be approved by the COR. The concept drawings present two proposed patterns as example only. Contractor to propose the pattern available by qualified manufacturers. Wall system to meet the acoustical properties of the lecture hall.
s. Construct a new metal stud and gypsum boards wall system in room 115 to provide access instead of the demolished door of the office adjacent to room 115. Provide new door frame, door including all locks, hardware, door stopper for the new doors installed.
t. Paint all new ceiling, walls and portion of the walls exposed after installing the acoustical wall panels with commercial Low-VOC paint system. colors to be as approved by the COR.
u. Install a new door at the main hallway 102 for room no. 117. Match existing doors at the hallway.
v. Any existing artwork shall be preserved and not painted over or covered up. Get with the COR to get approval before painting over any exiting artwork.
w. Perform code analysis for the required number bathroom fixtures of the building considering the new occupation resulted from this project. If additional bathrooms required, proposed rooms to be used as additional bathrooms are room 117 and/or 116. Contractor to verify and propose the best configuration or rooms to be used for this purpose.
x. Supply and install new sound system including ceiling recessed sound speakers.
y. Supply and install new ceiling recessed lighting. Lighting desired is a combination of ceiling recessed troffer
2’x2’ LED light and 6” round downlights. Contractor to design the best configuration of optimum lighting.
Lighting system to include the required occupancy sensors and all other requirements for fully functional energy saving system.
z. Supply and install new projector and projector screen. Projector to be mounted in the ceiling. Install the required ceiling mounted power receptacle and data outlet at the projector hanging location. Projector screen to be 150” motorized ceiling mounted drop down type.
aa. Demolish the existing indoor and outdoor HVAC split system. Patch and repair the wall for the existing piping penetration. Repair wall insulation if affected and match the existing finish for exterior walls.
bb. Supply and install new HVAC split energy saver system. place the outdoor compressor unit at a location adjacent to the proposed AHU. Supply and install precast concrete service pad for the outdoor unit. contractor to size the HVAC system for the new occupancy requirement of the lecture hall. The work will include all required control system, piping, instruments required for completing a fully functional system. All the control system to be compliant and compatible with the campus existing Honeywell Energy Management System (EMS). The new HVAC equipment shall be fully integrated into the EMS.
cc. Special consideration and design of the new HVAC system with respect to the noise level shall minimize or eliminate background noise to provide an optimum learning environment for the students.
dd. Install new duct system from the HVAC system with well distribution for the lecture hall occupancy. This is to include all rigid and flex ducts, supply, vent and return air and all associate grilles, diffusers, controls, instruments, insulation, power required.
ee. Remove the existing power panel and associated conduits, cables, cables trays, …etc to the loads. Contractor to install a new distribution panel sized to accommodate the new loads in accordance with the contractor’s approved design. Contractor to propose the new panel location. Contractor to verify the feeder cable size for new panel. If the existing feeder is not sufficient, contractor to supply and install new feeder cable from the main building switchboard to the new panel location. Contractor to design the required path and installation details of the new feeder.
ff. Supply and install new power distribution system from the new panel location to all loads locations. This is including but is not limited to the required cables trays, conduit system, wires, terminations, junction and pull boxes, …etc. power distribution systems to be concealed in the ceiling to the maximum extent possible except for the outlets required for the seating where it shall be concealed under the carpet or the floor structure. Contractor to perform all required core drilling floor cutting and patching, …etc.
gg. Supply and install new tables and seats for approximately 60 students shaped in an arch preferably. The preferred seating arrangement is moveable chairs and tables. The tables shall include manufacturer’s installed double power receptacles with double data outlets for every two students seating arrangement. The table will also include a concealed cables tray to run the wires for a continuous table row. Supply and install power outlets floor mounted
Mountain School at the end of each seating row to provide power and date to the intended seating row tables. Install cables from the new floor mounting outlets to each table outlet ran through the tables concealed duct. This is including all materials and work required for a fully functional systems installed.
hh. Supply and install the following equipment for smart classrooms need:
1. One white board. Size and coordination to be coordinated with the COR.
2. Smart board.
3. overhead projector and projector screen with receptacle ceiling mounted and a switch in the wall.
4. Smart Podium.
5. Tele/Power pole, wiremold/Legrand 30TP-4V or equal, two duplex power, two duplex CAT6 outlets.
6. Blank Tele/power pole, Wiremold/Legrand 30TC-4V or equal, with grommeted opening near bottom for cables from Podium to remote devices and equipment.
7. Ground receptacles for students’ desks as 2 duplex receptacles per desk.
8. Other data outlets and receptacles required in accordance with the design-built contractor design. Work to include all CAT6a UTP data cables, connectors, wall boxes, face plates, RJ45 connectors, J-Hooks or other hanging arrangements. Data cables to be run from the load back to the server rack location in the building.
Provide plenum classified data cables ran through plenum spaces.
CLIN #002 OPTION 1 – Fire Alarm System Bld. 112 Parker Hall
a. Contractor shall design a new fire alarm system for Bld. 112 Parker Hall.
b. Contractor will follow the BIA Plan review procedures to get approved drawings from DSRM and then proceed to construct and install the new system.
c. Contractor shall try to minimize any noise during construction if classes are in session and work with the COR to schedule work if needed.
d. Contractor shall install and test system per NFPA codes and provide documentation of acceptance.
e. There shall be one horn/strobe installed on the north exterior of the building to notify anyone close to the building.
Fire Alarm system will need to be inspected and approved by DSRM for final acceptance
f. Contractor shall provide attic stock of 2 extra smoke detectors, 2 heat detectors, 1 pull station, and 1 horn/strobe.
g. New fire alarm system shall be addressable and have hardware installed to connect a cellular device for reporting alarms and troubles.
h. Contractor shall provide any devices or test instruments needed to program any addressable devices for Haskell
Facilities personnel.
E. DELIVERABLES
The following deliverables are required when checked.

1. Submit baseline schedule using P6 software. Update schedule on monthly basis with narratives comparing the update to the baseline with all areas of impacts and mitigations taken to back to the project to track. Submit .Xer file with the baseline schedule and with every update.
2. Design to be submitted as 3 hard copies with the 2 copies of the design CAD files on compacted disk or an encrypted thumb drive with the encryption information provided to the COR. Coordinate with the COR for the desire method in compliance with the BIA cyber security compliance rules.
3. As part of the design, submit red marked edited specifications using the standard specifications site referenced in HINU School Facilities Design Guidebook.
4. All FIO submittals do not require the Government response unless the COR finds that the submittal is not in compliance with the contract. In this case, the COR will return the submittal for the proper corrective action required by the Contractor.
5. The Contractor shall submit for review samples, product data, and other submittals with the COR regarding details, materials, and equipment that will be used as part of the project. Remove the existing union kitchen electric panel in room 106, Supply and Install new panel in the union kitchen at the new location indicated in the drawings.
Coordinate routing of the removed panel overhead feeders for possible reuse from the new switchboard to the new panel location.
6. Approval of any submittal by the Government must not relief the contractor from the responsibility to comply with the contract and to comply to the respective submittal codes and standards. Approval of any submittal does not represent any approval for a deviation from the contract requirements. Deviations, changes shall be processed formally through the Contracting Officer as it is the authority of the Contracting Officer only.
7. Submit manufacturer’s standard warranty documents and contractor 1-year warranty documents 30 days prior to the final inspection for review. Submit O&M Manuals for every system supplied and provide digital copy, bookmarked with the as-built drawings.
8. The Contractor shall provide samples, color cards, etc. related to finishes for selection and approval by the COR.
9. The Contractor shall perform its own inspection prior to call the Government for a prefinal inspection. The
Government shall perform a joint prefinal inspection with the contractor upon work completion, the Government will issue a punch list and then the contractor will submit a request for final inspection with the supporting documents that the punch list was cleared by the contractor.
10. Submit a request for inspection 5 days prior to the intended inspection.
11. The Contractor shall provide all close out documents, including, but not limited to, construction documents, reports, record (“as built”) drawings, training, O&M manuals, warranty documents, ..etc. as required by the contract.

G. BACKGROUND INVESTIGATIONS
The Contractor shall be required to submit to a background investigation. The background check process will include, but may not be limited to, filling out hard copy forms, online forms, fingerprinting, and submitting documentation in a timely manner. Contractor will not be paid for any time associated with this process outside this contract but should include estimated costs in their bid to meet this requirement. It can take 2-5 weeks for clearance, so it is imperative to start this process as soon as possible. Typically, the Project Manager and the alternate is to submit paperwork (daily, payroll, testing, and weekly reports). The “Notice to Proceed” will not be issued until the background checks have cleared.

SECTION D – PACKAGING AND MARKING
D.1 PACKAGING AND MARKING
A. All shipments of materials, equipment and/or supplies to the project site shall be addressed to the
Contractor and not the Government. Preservation, packaging and packing shall be in accordance with standard practices for commercial packaging.
B. Government personnel are not authorized to accept deliveries for the contractor, nor are they responsible for off-loading shipments. A contractor representative must be present to accept deliveries.

SECTION E – INSPECTION AND ACCEPTANCE
E.1 52.246-12 INSPECTION OF CONTRUCTION AUG 1996
(a) Definition."Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.
(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.
(c) Government inspections and tests are for the sole benefit of the Government and do not-
(1) Relieve the Contractor of responsibility for providing adequate quality control measures;
(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;
(3) Constitute or imply acceptance; or
(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this- section.
(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer’s written authorization.
(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.
(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.
(g) If the Contractor does not promptly replace or correct rejected work, the Government may-
(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or
(2) Terminate for default the Contractor’s right to proceed.
(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction.
However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.
(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government’s rights under any warranty or guarantee. (End of clause)

E.2 DAILY REPORTING REQUIREMENTS
A. The Contractor shall prepare and file a "Contractor's Daily Report", for each day of contract performance.
Description must include contract number and work being performed. These reports shall be delivered to, or if directed, mailed to the Contracting Officer’s Representative on Fridays. The daily report shall include the name of Contractors and Subcontractors on-site, the number of workers and their labor categories employed on-site, the work being performed, the type of equipment on-site, any change order work being performed, and whether the work being performed is on schedule. Reports shall be numbered, dated and signed by the Contractor or his Project Manager. Failure to submit the daily reports could result in payments being withheld until such time as all daily reports are current.
E.3 FINAL INSPECTION
A. Contractor Self-Inspection. Prior to the completion date, the Contractor’s Quality Control Manager shall conduct a self-inspection of the site and document all items needing correction by means of a punch list. The corrected punch list shall be provided to the Contracting Officer’s Representative at the same time the pre-final inspection is requested. All punch list items must be corrected prior to requesting the pre-final inspection.
B. The Contractor and the Contracting Officer’s Representative will jointly conduct a pre-final inspection prior to requesting a final inspection. Any item needing correction shall be noted on the Pre-Final Inspection Punch List. Any discrepancies noted will be corrected prior to any final inspection. The Contracting Officer Representative may schedule more than one pre-final inspection if he determines it necessary.
C. When the Contractor is ready for final inspection, he will request final inspection in writing to the Contracting Officer and Contracting Officer’s Representative (COR). A copy of the Pre-Final Punch List shall be attached to this request with the corrective action taken noted. The final inspection will be requested at least 48 hours before the desired date.
D. The final inspection shall be performed with the Contractor by the COR, Contracting Officer, Safety Officer, and representatives of the using activity. Any discrepancies noted will be corrected within the time specified in the contract for the completion of work.
