About this file
This is Addendum No. 1 for a contract issued by the Northwest Bergen County Utilities Authority (NBCUA) for the Disposal of Incinerator Ash for the Wastewater Treatment Plant, with Solicitation Reference No. NBCUA-BID-25-003. The bid submission deadline has been extended to September 10, 2025 at 12:00 PM Prevailing Time, pushed back from the original August 19, 2025 deadline. The addendum includes responses to five prospective bidder questions that modify the original bid documents.
Key modifications include the deletion of Section G.24 on Liquidated Damages, which means contractors shall not include any liquidated damages provisions in their bids, and the addition of a new Section G.28 on Force Majeure. The Force Majeure clause provides detailed definitions and conditions under which performance delays may be excused, including events like natural disasters, government-ordered closures, strikes, and declared emergencies. The payment terms remain at NET 60 days, and the existing contract terms regarding consequential damages will stay in effect. Bidders are required to acknowledge receipt of this addendum in their bid submission, and all other terms and conditions of the original Request for Bid remain unchanged except as specifically modified in this addendum.
