1. Wage Determination
Exhibit D.11 2nd Paragraph 70
Please Clarify:
It states $16.20 /hr. but we were told as January 1, 2024, it is $17.20 /hr. for Federal Contractors.
Is the 2024 CWN Showers minimum $16.20?
1A
No. IAW FAR 52.222-55, Minimum Wages for Contractor Workers Under E.O. 14026 (in FAR 52.212-5): (b) Executive Order Minimum wage rate. (1) The Contractor shall pay to workers, while performing in the United States, and performing on, or in connection with, this contract, a minimum hourly wage rate of $15.00 per hour beginning January 30, 2022.
(2) The Contractor shall adjust the minimum wage paid, if necessary, beginning January 1, 2023, and annually thereafter, to meet the applicable annual E.O. minimum wage. The Administrator of the Department of Labor’s Wage and Hour Division (the Administrator) will publish annual determinations in the Federal Register no later than 90 days before the effective date of the new E.O. minimum wage rate. The Administrator will also publish the applicable E.O. minimum wage on https://www.sam.gov (or any successor website), and a general notice on all wage determinations issued under the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, that will provide information on the E.O. minimum wage and how to obtain annual updates. The applicable published E.O. minimum wage is incorporated by reference into this contract.
(3) (i) The Contractor may request a price adjustment only after the effective date of the new annual E.O.
minimum wage determination. Prices will be adjusted only for increased labor costs (including subcontractor labor costs) as a result of an increase in the annual E.O. minimum wage, and for associated labor costs (including those for subcontractors). Associated labor costs shall include increases or decreases that result from changes in social security and unemployment taxes and workers’ compensation insurance but will not otherwise include any amount for general and administrative costs, overhead, or profit.
(ii) Subcontractors may be entitled to adjustments due to the new minimum wage, pursuant to paragraph (b)(2).
Contractors shall consider any subcontractor requests for such price adjustment.
(iii) The Contracting Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (b)(3)(i) of this clause and will not provide duplicate price adjustments with any price adjustment under clauses implementing the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute.

Question # Attachment Section or Paragraph Page # Description / Question / Comment
1 MS Forms - Pricing Can I edit my Price response after submitting?
1A Yes, if you have Microsoft 365 account it will update the information previously entered. If not, a new response will need to be submitted – in the “comments to CO… field,” add a note/statement that let’s evaluators know what is going on. For instance, I updated prices, please disregard previous submission”, etc.
2 Will the recording be available to the public?
2A No. The recording is for government records only.
3 Wage Determination Are there specific “occupation codes” for this?
3A Nothing specific. Contractors are responsible for their determinations on codes. If you feel a code provided doesn’t match your definition of that employee, there are links to ask for conformance by DOL Wage and Hour Division (WHD) to add a new occupational code - it’s a process between the contractor and DOL WHD.
4 Proposal set-up.
4A
Follow instructions 52.212-1. Best practice: Technical – take each item required (assent to terms & conditions, attachment 1, past performance) put on a Word doc; Business – take each item required (signed SF1449/SF30s, amendments acknowledgement, the paper copy B.3 Price).
After completely answering each point, convert to PDF and combine all documents relating to that section into one document (1 business and 1 technical). Follow appropriate naming conventions and submit to the email/box address.
5 Email/box address
5A The address is a pinyon/box folder where responses are downloaded. Follow the subject line naming and attach docs and send. Please don’t put anything in the body of the email as that will not be included in the download.
The government only receives the attachment.
6 UINs vs VINs vs UEIs
6A
UINs are the unique identification assigned to the shower unit, K-1; Shower-1; etc., or what you identify each piece of equipment comprising the whole shower unit (tractor/trailer – ST-1, wash station – WS-1, potable water truck – PT-1, etc.), whereas the VINs are just that, and uses the VIN to verify MSFU equipment matches what was proposed, evaluated, and awarded. And finally, the UEI is the number replacing the former DUNS numbering for registration purposes.
7 Attachment 1 Minimum Equipment Requirements Checklist
7A
This checklist is to be filled out completely. Best practice: complete descriptions, not a rehash of the explanation.
For example, shower walls, describe the material; floors, describe the material and how the drainage is accomplished; pumps, include NSF61 certification; the unit is comprised of x-number heads; etc. Add pictures (right-side up) to the box at that point or add pages at the end of the attachment to place them – if doing this, contractors’ responsibility to include the reference (D1.2(a)(4), etc.) and to clearly describe the photo.
8 Other than wildland fire incidents
8A There is a possibility units could be requested for incidents other than wildland fire (hurricane, prescribed (Rx) burns, etc.). Remember, units can only be dispatched by NICC.
