Amendment No.2:
The following questions were brought up during the pre-bid site visit held on 05-05-2020:
Question: Will the contractor have to pay a royalty fee for materials removed from the Lamar and Kempner Ranch pits?
Answer: No. The Forest Service will NOT charge royalty fees for the material.
Question: What government furnished materials utilized in this project will the contractor be required to pay Idaho State sales tax on?
Answer: Yes
Under clause 52.236-7, Permits and Responsibilities, Contractors shall be responsible for complying with any Federal, State, and municipal laws, codes and regulations applicable to the performance of the work. Questions regarding assessment of Idaho Use Tax on Government Furnished Property should be directed to the Idaho State Tax Commission at (208) 334-7660 or 800-97-7660. Or email questions to taxrep@tax.idaho.gov https://tax.idaho.gov/i-2068.cfm
Using contractors on governments projects
Many government agencies use contractors to make improvements to real property. Idaho requires contractors to pay tax on materials they use to alter, improve or repair real property in Idaho. This includes materials that contractors use when they work for government agencies.
Government agencies can buy materials for their construction contracts without owing Idaho sales tax.
But if the government agency provides those untaxed materials to their contractor, the contractor owes use tax.
Contractors owe tax on the materials they use in a real property project. It doesn't matter whether the contractor buys or makes the materials, or the government agency provides the materials for the project. Because of this, contractor bids should include:
• Use tax on materials the government agency bought tax exempt and gave the contractor to use
• Sales tax on materials the contractor buys for real-property improvement contracts
Contractors should include these taxes in the bid because they're part of their cost. The government agency will reimburse contractors for the taxes they paid when they bill the agency for those taxes.
Exception: Materials donated to a government agency for incorporation into a real property project aren't subject to use tax. This is the only exception.
Amendment #2-12026120R0004 mailto:taxrep@tax.idaho.gov https://tax.idaho.gov/i-2068.cfm
Example:
An Idaho government agency requires its contractor, ABC Contractors, to provide a cost breakdown for materials used. ABC bought $50,000 worth of materials and paid 6% sales tax. ABC should show its cost as $53,000 on the bill.
Contractors can read more about their tax responsibilities in our Contractors Working in Idaho guide.

Contractors and crushed rock
A contractor who applies crushed rock or other related real property materials is improving real property. As a result, the contractor who buys this material must pay tax on the purchase price. If this material is provided by the project owner or a government agency (who haven't paid tax on the material), the contractor owes tax on the value of the rock or related real property material. The value of the rock is the "crushed value" – what a buyer would pay to a gravel pit owner for this type of product. If the contractor who applies the rock is also the crusher, the value of the rock is the raw material cost (generally the royalty fee).
When a rock crusher contracts to crush and stockpile rock owned by another, the rock crusher is not a contractor improving real property. Instead, the rock crusher is a retailer of taxable processing services.
The rock crusher must get a seller's permit number and charge sales tax on retail sale of crushing services (including mobilization fees). However, no tax applies if the customer, such as a state or federal government agency, is exempt from paying sales tax.
If the rock crusher is crushing and stockpiling rock for a customer who will resell it, the services aren't taxable if the buyer provides a completed form ST-101. The rock crusher may qualify for the production exemption on equipment, fuel, and certain supplies if the majority of the business is crushing rock that will be resold. This is true even if the crusher isn't the owner of the rock.
There is material piled at Lamar Creek was dumped (donated) by the Idaho Transportation Department for the Forest Service to you use. The Forest Service did NOT pay anything for producing it.
Question: Is it permissible for a contractor to supply and install a temporary stream crossing structure at AOP construction sites to provide a way for equipment and delivery trucks to cross the stream channel?
Answer: A temporary structure may be installed if it lies within the construction limits shown on the drawings. If installed, public use of the structure needs to be barred by the contractor.

Question: Can a wheel loader scale system be used to measure weights for Pay Item 20415 Roadway Embankment hauled to Road 384 from the Lamar pit?
Answer: No. Per FP-14 specifications under subsection 109.03(c), only platform and belt-conveyor scales are permissible as Project Weighing Systems. Subsections 109.03(c) and 109.04 list the contract requirements, including record keeping, for both weighing of the material after it is loaded into trucks and the delivery to the embankment sections on Road 384.
