About this file

This document is a Terms and Conditions agreement for a Request for Proposal issued by Dallas Independent School District (DISD) Food and Child Nutrition Services to procure fresh dairy products and juice for district-wide delivery to individual schools, the central kitchen, and potential future locations. The contract covers three distinct product lots: a Milk Lot (including various types and sizes of milk, butter, sour cream, and yogurt products), a Shelf Stable Milk Lot, a Juice Lot (featuring multiple juice varieties in 4-ounce containers), and a Miscellaneous Lot (comprising cheese, cream, and related dairy products). The contract term runs from March 27, 2026, through March 26, 2027, with options for two subsequent one-year renewals, not to exceed three years total. Delivery is required to individual school cafeterias daily between 7:00 AM and 2:00 PM Central Time, with additional weekly deliveries to the Maria Luna Building warehouse. All products must meet USDA specifications, be Grade A Pasteurized and Homogenized for milk, maintain refrigeration temperatures of 41°F or lower, and arrive with a minimum seven-day shelf life.

Pricing for all items except fluid milk must remain firm throughout the contract period, while fluid milk pricing is variable and tied monthly to the Southwest Federal Milk Order Class I Raw Milk-Dallas location pricing, with ten business days' written notice required for any price changes. The district reserves the right to award each lot separately to different vendors or consolidate all lots to a single provider based on best value determination, and retains discretion to purchase additional, fewer, or no quantities beyond the estimated annual amounts listed on bid forms. The contract requires vendors to provide individual invoices for each school signed by cafeteria supervisors, submit monthly usage reports by the tenth of each month, maintain formal product recall communication plans, and deliver samples within one week of bid closure if requested. The district may cancel the contract for non-conformance with delivery schedules, specification deviations, brand substitutions without approval, or product quality issues, and vendors are subject to financial penalties if insufficient products are delivered to meet Child Nutrition Guidelines. The procurement is issued in accordance with Title 2 of the Code of Federal Regulations Part 200 and USDA and Texas Department of Agriculture requirements, utilizing federal, state, local, and grant-funded program dollars.
