About this file
Summary
This is a Section 3 Contract Compliance Package document issued by the Wilmington Housing Authority that outlines requirements for contractors and subcontractors working on federally-funded housing and community development projects. The package implements the HUD Final Section 3 Rule (24 CFR Part 75), which became effective on November 30, 2020, and replaces the previous rule at 24 CFR Part 135. The compliance package applies to all service-related contracts regardless of dollar amount or project duration, with exemptions for material and supply-only agreements and certain professional services including CPAs, attorneys, engineers, and architects. Contractors and subcontractors at all tiers must include this package in their contracts and ensure compliance through lower-tiered subcontracts. Monthly reporting is required by the 15th of the following month using the Section 3 Reporting Form (Attachment A), with submissions directed to COMPLIANCE@MOTIVATION-INC.COM.
The Section 3 benchmarks require that at least 25 percent of total labor hours be performed by Section 3 workers (low or very low-income persons residing in the metropolitan area) and 5 percent by Targeted Section 3 workers (employees of Section 3 businesses, Section 3 workers within the project service area, and YouthBuild participants). Section 3 businesses must be at least 51 percent owned by low- or very low-income persons and in operation for at least six months, or have over 75 percent of labor hours performed by low- or very low-income persons based on prior 90-day payroll records. If benchmarks are not met, the general contractor must submit a Qualitative Efforts Report documenting outreach activities such as advertising in local publications, posting notices in public housing communities, contacting job training centers, and referring candidates to American Job Centers. Each contractor and subcontractor must complete the Section 3 Compliance Acknowledgment (Attachment H) at contract execution and provide the Section 3 Brochure (Attachment B) to all parties. All persons and businesses must be fully qualified to perform the work, and no solicitation points may be awarded based on Section 3 business status.

SECTION 3 CONTRACT COMPLIANCE PACKAGE
1 INTRODUCTION
This document provides the necessary information, forms, and procedures for Contractors and Subcontractors of the project (“Project”) to comply with Section 3 of the Housing and Urban Development Act of 1968 (“Act”). On November 30, 2020, HUD implemented a Final Section 3 Rule (“Final Rule”) for all recipients. The Final Rule is found at 24 CFR Part 75 and replaced the previous rule found at 24 CFR Part 135. Please take note that the Final Rule is significantly different from the previous rule.
Every contractor must ensure this package is included in their applicable contracts and sub-contracts through all tiers. Every sub-contractor must include this package in their lower-tiered sub-contracts.
This new rule exempts all material and supply only agreements. The rule applies to all service-related contracts/agreements despite the dollar amount or project duration. Certain professional services are also exempt, such as CPA’s, Attorneys, Engineers, and Architects.
