About this file
This is a Textbook Master Price Agreement document between Clark County School District in Nevada and a textbook publisher for Physics and Honors Physics textbook adoptions. The contract encompasses a seven-year term from July 1, 2026, through June 30, 2033, with an opening date of May 28, 2026. The District seeks textbooks, related support materials, and educational services to support a one-year physics course designed to integrate scientific and engineering practices, with mandatory demonstrations and lab experiences employing proper safety techniques. The course fulfills high school science credit requirements and qualifies as a laboratory science for college entrance. The agreement includes provisions for staff development and services as reasonably requested by individual schools in accordance with the provider's standard practices, with additional services beyond standard practices to be annotated in the supplemental materials schedule.
Pricing for the textbooks and support materials must represent the lowest price the provider has charged anywhere in the continental United States, consistent with a "most favored nations" clause, with the provider obligated to immediately disclose and adjust prices if lower rates are utilized elsewhere during the contract term. The provider may request a one-time price increase after the fourth year of adoption, not to exceed the current price charged to other school districts. Deliveries are to be made FOB Destination with Freight Prepaid, with a one percent per day penalty assessed for deliveries exceeding 45 days from order receipt, capped at the value of the undelivered portion. The provider must maintain sufficient inventory throughout the agreement term and replace any defective textbooks at its own expense. The District retains the right to terminate the agreement without penalty for sufficient cause, including curriculum revisions, funding limitations, or concerns regarding content standards, with a 30-day cure period provided for performance failures. The agreement may be made available to all Nevada school districts upon execution.
