About this file

This is a Student Data Usage Questionnaire issued by the Clark County School District's Technology and Information Systems Services Division to ensure compliance with Nevada Revised Statutes 388.291. The questionnaire requires all current or prospective educational software and educational services application vendors to provide detailed information regarding their collection, use, and protection of student data in easy-to-understand language before the district may implement their applications or services.

The questionnaire addresses 28 substantive questions covering critical data privacy and security requirements, including the types of student information collected, purposes of data usage, data retention and deletion policies, compliance with the Family Educational Rights and Privacy Act (FERPA), the Children's Internet Protection Act (CIPA), and the Protection of Pupil Rights Amendment. Vendors must disclose whether their applications involve direct teacher-student communication, whether student data is used for commercial purposes unrelated to requested services, whether artificial intelligence is employed in the application and if student data is used to train or improve AI models, whether the application enables students to access inappropriate internet material or electronic communications, and what safeguards exist to prevent unauthorized access or disclosure of personally identifiable information. Additionally, vendors must provide URLs or copies of their terms of service and privacy policies, describe all security measures protecting personal information, explain how district officials can access logged communications, and confirm whether their applications meet the district's seven-year data retention requirements. The questionnaire submission must include the vendor's name, the name and contact information of the person completing the questionnaire, and any additional information relevant to the application approval process.
