About this file
This document is a Certification of Compliance with FAA Buy American Preference form involving the Federal Aviation Administration (FAA) and federal procurement regulations under 49 USC § 50101. The form requires bidders or offerors to certify their compliance with Buy American Laws by selecting one of two mutually exclusive certification statements: either fully complying with U.S. domestic product requirements or requesting a waiver for non-compliance. Bidders must provide documentation about the source and origin of iron, steel, manufactured products, and construction materials, with specific requirements for installing products produced in the United States or qualifying for specific types of waivers.
The document outlines four potential waiver types: Type 2 (Nonavailability) for materials not available in sufficient U.S. quantity or quality, Type 3 for projects where U.S. component costs exceed 60% of total component costs, and Type 4 for situations where domestic product requirements would increase overall project costs by more than 25%. Each waiver type requires detailed documentation, including completed Content Percentage Worksheets, market research records, component cost analyses, and comparative bid information. The form warns that false statements may subject the maker to prosecution under Title 18 of the United States Code, emphasizing the legal seriousness of the certification process.

domestic content percentage as approved by the FAA.
