About this file
This document is Addendum #5 for RFP-RC-2025-016, issued by the Rockland County Department of General Services, Purchasing Division for an Incarcerated Individual's System including Digital Mail Services and Tablet Program for the Rockland County Correctional Center. The addendum clarifies several key aspects of the request for proposal, including the required proposal response format (using page 39's 7-section format), confirming that only 3 references are required, and explicitly stating that the county will not accept bids on call rates exceeding the 2024 FCC Order. The county requires that the digital mail processing center be located in New York State and will not implement remote video visitation at this time.
The addendum extensively addresses revenue generation and compliance with the 2024 FCC Order, specifically prohibiting commissions on regulated revenue from phone calls or video sessions. The county will only allow commissions on non-regulated revenue streams like tablet media, e-messaging, tablet subscriptions, and text content. Vendors must submit projected gross billed revenue, commission percentages, and detailed explanations of commission calculations. The county will require vendors to maintain accurate call accounting records, provide monthly reports on generated revenues, and submit additional commission checks if annual guaranteed fees are exceeded. Critically, the county will not award bids that do not fully comply with the 2024 FCC Order requirements, including restrictions on safety and security services funded by regulated revenue.

5 4.01 – Annual Guaranteed Fee – How can the agency request upfront annual commissions from regulated services when that violates the 2024 FCC Order? 7 4.03 – Revenue Generation –“The vendor is to provide an Annual Guaranteed Fee based upon a percentage commission of the GROSS BILLED REVENUE, less applicable state or federal taxes, generated at each incarcerated individual telephone station. Gross revenue is defined as revenue for all billed calls without exception. The following will be required of each vendor” Is the agency still requesting most of this information even though it violates the 2024 FCC Order? If not, can the agency send a revised wording for this section? The commission on calls is removed and only non-regulated commissions based on the 2024 FCC guidelines will be accepted
