About this file

This document is a Certification Regarding Lobbying form (VA Form 40-0895-9) issued by the Department of Veterans Affairs for use by State, Tribal, or eligible County government entities in connection with State Cemetery Grants authorized under 38 U.S.C. 2408. The form is applicable to the Northern Utah Veterans Cemetery project (Project #26360490), a construction initiative by the State of Utah Division of Facilities Construction and Management (DFCM) to establish a new veterans memorial cemetery in Washington Terrace, Utah. The project encompasses site improvements, utility infrastructure, hardscape, irrigation, landscaping installation, and building construction, with an estimated construction cost of $12,000,000. This certification form must be completed and signed by the appropriate state certifying official prior to the award or execution of the grant agreement.

The certification requires the undersigned to affirm, to the best of their knowledge and belief, that no federal appropriated funds have been or will be paid to influence any officer or employee of a federal agency, Member of Congress, or congressional staff in connection with the awarding of this federal grant. Should any non-federal funds be used for lobbying purposes, the certifying official must submit Standard Form-LLL disclosing such activity. The form further mandates that this certification language be included in all subaward documents at all tiers and that all subrecipients provide corresponding certifications. Failure to submit the required certification subjects the responsible party to civil penalties ranging from $10,000 to $100,000 per violation. The form carries OMB Number 2900-0559 with an expiration date of October 31, 2026, and the estimated respondent burden is 15 minutes.
