About this file
This is a Business Confidentiality Claim Form issued by the Utah State Archives Office of the Government Records Ombudsman, applicable to the Salt Lake City School District's (SLCSD) Invitation for Bid for the Wasatch Elementary Tunnel Waterproofing Project. The form provides guidance to bidders seeking to protect trade secrets and commercial financial information from public disclosure under the Government Records Access and Management Act (GRAMA). A mandatory pre-bid site visit is scheduled for Tuesday, April 14, 2026, at 9:00 A.M. at Wasatch Elementary School located at 30 R Street, Salt Lake City, Utah 84103, with contractors required to meet on the south side of the building near the tunnel entrance. Non-attendance at this mandatory meeting will result in bid disqualification. The solicitation seeks qualified vendors to provide all labor, materials, equipment, traffic control, surface preparation, waterproofing injection, joint sealant replacement, localized concrete repair, and cleanup to stop water infiltration into the pedestrian tunnel beneath South Temple and restore damaged overhead concrete. All questions must be submitted in writing through the Bonfire/U3P platform or asked during the pre-bid site visit, with responses posted on Bonfire/U3P as the sole official source of information.
Bidders claiming confidentiality must submit both redacted and non-redacted versions of their proposals, with the SLCSD declining to perform redactions on behalf of claimants who fail to provide a redacted copy. The confidentiality claim must include a concise statement of reasons supporting the claim in accordance with Utah Code Section 63G-2-305, which protects trade secrets and commercial financial information that could result in unfair competitive injury if disclosed. Submission of a confidentiality claim does not guarantee protected classification if the government receives a records request. All bids must be submitted electronically on Bonfire/U3P with required documentation including bid bonds, licensing, and any additional documents specified in the bid documents. Any modifications to the procurement will be issued only through authorized addenda by the SLCSD, and bidders acknowledge by submission that they have examined and familiarized themselves with all bid document requirements and governing conditions.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted.
