About this file
This is a Domestic Partnership Act Certification form required by Broward County, Florida for vendors submitting bids on the Demolition of Air Monitoring Site project. The certification must be completed and returned with the vendor's submittal to satisfy responsiveness requirements or to qualify for the Domestic Partnership tiebreaker in bid evaluation. Vendors contracting with the County for goods and services in amounts exceeding $100,000 must certify their compliance status with Broward County's Domestic Partnership Act (Sections 16-150 through 16-165), which requires the provision of benefits to registered domestic partners of employees on the same basis as benefits provided to employees' spouses. The form requires vendors to select one of three primary compliance options: current compliance with the Act, commitment to comply at the time of contract award, or non-compliance; alternatively, vendors may qualify for specific exemptions based on company size, benefit structure, organizational type, or conflicting legal obligations.
Vendors must complete and sign the certification form, indicating their name, representative name, title, and date. Failure to submit the form by the stated deadline may result in a determination of non-responsiveness to the solicitation or ineligibility for the Domestic Partnership tiebreaker advantage. For contracts under $100,000, the certification may not be applicable. Vendors with fewer than five employees, those that do not provide spouse benefits, governmental entities, not-for-profit organizations, religious institutions, those providing cash equivalents of benefits, or those with conflicting federal or state legal obligations may qualify for exemption from the Act's requirements by documenting the applicable exception on the form.
