About this file
This is a Domestic Partnership Act Certification form required by Broward County, Florida for vendors seeking contracts with the County. The certification applies to all solicitations valued over $100,000 and must be completed and submitted with the vendor's bid response. Vendors are required to certify their compliance status with Broward County Code of Ordinances Sections 16-150 through 16-165, which mandates that contractors provide benefits to registered domestic partners of employees on the same basis as benefits provided to employees' spouses. The form requires vendors to select one of three compliance statements: current compliance with the Domestic Partnership Act requirements, commitment to comply at the time of contract award, or non-compliance at the time of award. For contracts related to the Runway Acrylic Traffic Paint open-end procurement for Broward County's Aviation Department, vendors must return the completed and signed certification form with their solicitation submittal through BPRO by the closing date and time to be considered responsive.
The certification form allows vendors to claim exemptions from the Domestic Partnership Act requirements if specific conditions apply, including having fewer than five employees, not providing spousal benefits, operating as a governmental entity or not-for-profit organization, or demonstrating that compliance would violate federal or state law or the terms of a government grant or contract. Vendors claiming exemptions must check the applicable box and provide supporting documentation as required. Failure to submit the completed form by the stated timeframe may result in the vendor being deemed nonresponsive to the solicitation. Additionally, vendors seeking eligibility for the Domestic Partnership tiebreaker advantage must submit the form at the time of solicitation submittal and certify current compliance with the Act's requirements; vendors missing this deadline will be ineligible for the tiebreaker preference.
