About this file

This is a Confidential and Proprietary Information Declaration Form issued by Salt Lake City Corporation Purchasing & Contracts Management Division for use by contractors or private providers responding to Request for Bid SLCI27015 regarding a one-time purchase of a Slurry Dual Spray Squeegee Machine. The form allows bidders to identify and protect trade secrets and commercial financial information in accordance with Utah Code 63G-2-305 and 63G-2-309. Contractors may submit confidentiality claims for records they believe qualify for protected classification, provided they submit the claim concurrently with the information to be protected and include a concise statement of reasons supporting the claim.

The form requires claimants to provide company information, specify which pages and paragraphs of submitted documents should be protected, and identify the reason for the confidentiality claim. Importantly, the form includes a disclaimer that making a confidentiality claim does not guarantee protected classification if the governmental entity receives a records request under the Government Records Access and Management Act (GRAMA). Bidders may indicate whether they are providing a redacted public copy of the records alongside the confidential submission. The form includes fields for the claimant's signature, date, and detailed identification of the specific records being claimed as confidential.

Business Request for GRAMA Business Confidentiality Claim For use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
