About this file

This is a Confidential and Proprietary Information Declaration Form issued by Salt Lake City Corporation Purchasing & Contracts Management Division for use by contractors and private providers in connection with the eBike Maintenance contract opportunity (SLCI27006). The form enables bidders to identify and protect trade secrets and commercial financial information from public disclosure under the Government Records Access and Management Act (GRAMA) in accordance with Utah Code 63G-2-305 and 63G-2-309. Contractors submitting confidentiality claims must provide a concise statement of reasons supporting the claim and specify which pages and paragraphs of their submission contain protected information, along with an explanation for each claim. The form requires claimant information including company name, address, representative contact details, and the specific records or information being submitted for protection.

The form serves as a procedural mechanism for maintaining competitive proprietary information during the bidding process, though it does not guarantee protected classification if the governmental entity receives a public records request. Bidders must elect whether a public redacted copy of their records is being provided alongside the confidential submission. Claimants must acknowledge that making a confidentiality claim does not automatically ensure protection and that disclosure determinations will be made by Salt Lake City Corporation in accordance with applicable state law and the reasons provided in their claim statement.

Business Request for GRAMA Business Confidentiality Claim For use by contractors or private providers to identify protected records or information

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
