About this file
This Claim of Business Confidentiality document is submitted in support of a proposal to the State of Utah Division of Purchasing and the Governor's Office of Economic Development (GOED) for the Agency of Record – Outbound Campaigns contract. The procurement seeks a Design Professional Service Provider and Consultant to establish a proof of concept for outbound marketing and communications designed to attract opportunity and investment to Utah's economy. The contract term is one year, and the procurement is conducted under Utah Procurement Code 63G-6a Part 15. The vendor submission should include statements of qualifications without pricing information, as the highest-ranked vendor will be selected to negotiate contract terms at fair and reasonable compensation determined through subsequent negotiations.
The confidentiality claim document asserts that portions of the submitted proposal contain proprietary business information, trade secrets, or confidential technical data that the submitting vendor requests be withheld from public disclosure. This filing protects sensitive information such as methodologies, market analysis, proprietary processes, or other competitive information that the vendor deems confidential. The state will evaluate claims of confidentiality in accordance with Utah's public records laws and procurement regulations. If fair and reasonable compensation cannot be negotiated with the highest-ranked vendor, the state reserves the right to proceed with negotiations with the next highest-ranked vendor. No specific funding amounts or set-asides are detailed in this confidentiality claim document.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
