About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in conjunction with the State of Utah Division of Purchasing and the Department of Corrections for a Request for Proposal (RFP) regarding Urinalysis Laboratory Equipment. The RFP seeks a single contract award to a responsive and responsible vendor for the provision of urinalysis laboratory equipment as detailed in the Scope of Work attachment. The procurement follows a two-stage evaluation process, with Stage 1 consisting of initial review for responsiveness and compliance with mandatory minimum requirements, and Stage 2 involving technical proposal evaluation by a committee against six criteria: Training (150 points), Service/Maintenance (200 points), Installation (150 points), Work History (50 points), Subcontractor Compliance (150 points), and Software System (100 points), for a total of 800 possible points. Proposals must achieve a minimum score of 560 points to proceed to final cost proposal evaluation; those scoring below this threshold are deemed non-responsive and ineligible for further consideration.
This form serves as a template for vendors to claim confidentiality protections under Utah Code sections 63G-2-305 and 63G-2-309 for trade secrets and commercial financial information included in their proposals. Vendors submitting confidentiality claims must provide both redacted and non-redacted versions of their proposals, with the Division of Purchasing declining to perform redactions on behalf of claimants who fail to submit a redacted copy. The confidentiality claim does not guarantee protected classification if the government receives a records request under the Government Records Access and Management Act (GRAMA). All confidential submissions must include the claimant's company information, a concise statement of reasons supporting the claim, and specific details regarding which pages, paragraphs, and information require protection.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
