About this file
This file is a GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the State of Utah Division of Purchasing's RFP MD26-18 for psychological evaluations services to be provided to the Board of Pardons and Parole. The form serves as a template for vendors submitting proposals to claim protection for trade secrets and commercial financial information that could be competitively sensitive. Under Utah Code 63G-2-305 and 63G-2-309, vendors may protect trade secrets and commercial financial information from public disclosure if they submit a concise statement of reasons supporting the confidentiality claim. The contract opportunity is anticipated to result in a single award to the responsive and responsible vendor with the highest combined score from technical and cost evaluation stages, with a contract term of five years and guaranteed pricing for a minimum of two years.
Vendors submitting proposals must include both redacted and non-redacted versions of their proposals; the Division of Purchasing will not redact proposals on behalf of vendors who fail to provide a redacted copy. The confidentiality claim form requires vendors to identify specific pages, paragraphs, and the reasons confidential protection is being claimed. Importantly, submitting a confidentiality claim does not guarantee that information will receive protected classification if the government receives a public records request. Vendors must provide detailed claimant information including company name, address, company representative name and contact information, and a clear statement of reasons explaining why specific sections of their proposal warrant confidential treatment.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
