About this file

This file is a Business Confidentiality Claim form from the Utah State Archives Office of the Government Records Ombudsman, used in conjunction with a procurement opportunity issued by the State of Utah Division of Purchasing and the Department of Health and Human Services. The form is designed to allow vendors submitting proposals to claim protection for trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. The procurement (BB26-26) seeks Maico EroScan DPOAE hearing screening equipment or equivalent, with a contract term of one year. Vendors submitting proposals must provide both redacted and non-redacted versions of their documentation; failure to submit a redacted copy will result in the Division of Purchasing declining to perform redactions on behalf of the claimant.

The confidentiality claim form requires vendors to provide detailed claimant information including company name, address, representative contact details, and a concise statement explaining the specific reasons for claiming confidentiality protection for designated sections of their proposal. Claimants must identify the exact pages and paragraphs for which confidentiality is claimed and provide justification for each claim. The form notes that submission of a confidentiality claim does not guarantee protected classification if the government receives a public records request under the Government Records Access and Management Act (GRAMA). The vendor must guarantee pricing for the one-year contract period, with the award intended for the responsive and responsible vendor with the highest score as justified by Utah procurement code.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
