About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives' Office of the Government Records Ombudsman for use in the RM26-8 Sandbags procurement conducted by the State of Utah Division of Purchasing. The form is designed to allow vendors submitting proposals to protect trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Vendors responding to this Request for Proposal for the purchase of sandbags used for flood control throughout the State of Utah must submit both redacted and non-redacted versions of their proposals if they wish to claim confidentiality protections. The RFP is for a five-year contract term with potential for multiple awards based on technical score and total score thresholds, and vendors must guarantee pricing for one year and any discount percentages for the life of the contract.
The confidentiality claim process requires vendors to provide a concise statement of reasons supporting their claim, including company information, contact details, and specific identification of which pages, paragraphs, and sections of the proposal require protection. Vendors must submit the completed confidentiality claim form with their proposal materials. The Division of Purchasing will not redact proposals on behalf of vendors who fail to submit a redacted version. It is important to note that submission of a confidentiality claim does not guarantee that the information will receive protected classification status if the government receives a public records request under GRAMA (Government Records Access and Management Act). An administrative fee of 0.0% applies to this procurement.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
