About this file
This is a Business Confidentiality Claim Form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the MK26-21 Chronic Disease Prevention Partnership contract opportunity managed by the State of Utah Division of Purchasing and the Department of Health and Human Services. The procurement seeks design professional service providers and consultants to deliver training to selected Health Centers and affiliates, with the Department of Health and Human Services reserving the right to add additional services, including the Healthy Environments, Active Living (HEAL) program, at any time during the contract term. The contract has a five-year duration, and vendors are instructed to submit statements of qualifications without pricing information. The vendor receiving the highest ranking will be selected to negotiate a contract at compensation determined to be fair and reasonable, with the state retaining the right to proceed with the next highest ranked vendor if negotiations fail.
The confidentiality claim form allows vendors submitting proposals to protect trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Claimants must submit both redacted and non-redacted versions of their proposals, with the entire proposal not permitted to be fully redacted, and must provide a concise statement of reasons supporting any confidentiality claim. The form requires claimant information including company name, address, representative contact details, and specific identification of pages, paragraphs, and reasons for claiming confidentiality protection. The state notes that making a confidentiality claim does not guarantee protected classification if the government receives subsequent records requests under the Government Records Access and Management Act (GRAMA).

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
