About this file

This is a GRAMA Business Confidentiality Claim form issued by the Utah State Archives' Office of the Government Records Ombudsman in support of the MW26-13 Training for Substance Use Prevention Professionals solicitation administered by the State of Utah Division of Purchasing and the Department of Health and Human Services. The solicitation requests statements of qualifications from vendors to provide workforce development training specific to the Universal Prevention Curriculum Coordinator Series (UPC-C) professional education program. The contract is intended to be a five-year engagement for Design Professional Service Providers and Consultants under Utah Procurement Code 63G-6a Part 15. Vendors must submit statements of qualifications without pricing information by the specified deadline via email to mwoodward@utah.gov with the subject line "MW26-13 Statement of Qualifications submission," with late submissions not accepted. The vendor receiving the highest ranking will be selected to negotiate contract terms at fair and reasonable compensation; if negotiations fail, the state may proceed with the next highest-ranked vendor.

The confidentiality claim form provides a mechanism for vendors to protect trade secrets and commercial financial information from disclosure under the Utah Government Records Access and Management Act (GRAMA), provided the claim is submitted with both redacted and non-redacted versions of the proposal. Claimants must include a concise statement of reasons supporting the confidentiality claim and provide company information, including company name, address, representative contact details, and specific identification of the records requiring protection by page, paragraph, and stated reason. The form emphasizes that submission of a confidentiality claim does not guarantee protected classification if the government receives a public records request, and vendors submitting proposals must comply with these requirements or face non-redaction by the Division of Purchasing.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
