About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the Utah Office of Tourism's custom exhibition booth and operational services procurement. The form provides a standardized template for vendors submitting qualifications to the State of Utah Division of Purchasing to claim confidentiality protection for trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Vendors responding to the Request for Statements of Qualifications (RFSQ) for design, fabrication, installation, and five-year on-site operation of a custom exhibition booth at the IPW Conference must submit both redacted and non-redacted versions of their proposals if they wish to protect sensitive information from public disclosure under the Government Records Access and Management Act (GRAMA).
The confidentiality claim requires vendors to provide detailed information including company name, representative contact details, and a concise statement of reasons explaining why specific pages, paragraphs, or sections warrant protection. Vendors must identify the governmental entity receiving the submission, specify which records require confidentiality protection, and explain the basis for each claim. The form emphasizes that making a confidentiality claim does not guarantee protected classification if the state receives a records request, and that the Division of Purchasing will not redact proposals on behalf of vendors who fail to submit redacted versions. No pricing information should be included in the initial qualifications submission, as the highest-ranked vendor will be selected to negotiate fair and reasonable compensation through subsequent contract negotiations.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
