About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman for use by contractors and private providers in connection with a K-12 Keyboarding Digital Platform Request for Proposal issued by Granite School District in Utah. The RFP seeks a vendor to provide keyboarding instruction and assessment services to elementary students in grades K-5 according to the attached Statement of Work (AL26-016). The contract resulting from this procurement will have an initial term of one year, with the option for the school district to extend the agreement year-to-year for up to four additional years at its discretion and with mutual agreement between parties. The district anticipates awarding the contract to the responsive and responsible vendor with the highest score in accordance with applicable procurement code requirements.
The Business Confidentiality Claim form allows bidders and contractors to identify protected records and information submitted in response to the procurement, specifically trade secrets and commercial financial information that could reasonably result in unfair competitive injury if disclosed. Per Utah Code 63G-2-305 and 63G-2-309, claimants must submit a concise statement of reasons supporting the confidentiality claim along with the protected information. The form requires submission of claimant company information, details about the confidential records being claimed, identification of the specific pages and paragraphs requiring protection, and the business rationale for the confidentiality request. Notably, submitting a confidentiality claim does not guarantee that information will receive protected classification if the government receives a public records request under the Government Records Access and Management Act (GRAMA).

Business Request for GRAMA Business Confidentiality Claim use by contractors or private providers to identify protected records or information
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
