About this file
This is a Contract Disputes Form appendix from the Florida Department of Financial Services related to a law enforcement vehicle upfitting solicitation. Respondents must disclose all contract disputes occurring within the three years preceding bid submission, including circumstances where the respondent was identified as in default or breach, received notice of default, faced judicial or quasi-judicial action, or had fines or damages assessed. The disclosure requirement applies to disputes related to contracts under which the respondent provided commodities and/or services in the United States on an organizational or enterprise level that may impact the respondent's ability to provide law enforcement vehicle upfitting services. For each reported dispute, respondents must identify the related contract, explain the nature of the dispute, and describe whether and how it was resolved. The form permits respondents to indicate either that they have no contract disputes to report or to list all applicable disputes with supporting documentation on additional pages as necessary.
This disclosure requirement is a mandatory certification element of the competitive sealed bid process administered through Florida's Vendor Information Portal. The solicitation covers upfitting a minimum of 20 vehicles per fiscal year, with the initial contract term of three years from execution date and renewal options for up to three additional years contingent upon satisfactory performance and available funding. The Department anticipates awarding the contract based on the lowest combined score of part markup percentage above manufacturer's suggested retail price and hourly labor rates for installation services. Respondents must maintain a service location within 20 miles of the Department's headquarters in Tallahassee and provide a $200,000 commercial general liability insurance policy. Financial consequences for non-performance include a $2,100 penalty per missed biannual meeting and five percent invoice deductions for failure to accept vehicle delivery or complete work on schedule, with additional five percent deductions for every seven calendar days of delay thereafter.
