SECTION C - DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C. STATEMENT OF WORK

C. 1. OVERVIEW/BACKGROUND.

The Library of Congress (Library) requires a contractor to produce, maintain, and support the latest generation of Digital Talking Book Machine (DTBM) devices, known as the DA2 (DTBM model Digital Advanced version 2), which were originally launched June 18, 2025.

The National Library Service for the Blind and Print Disabled (NLS) provides free books and magazines in audio and braille format to eligible U.S. residents and citizens living abroad. NLS’ enabling legislation was changed in 2016 (Public Law 114-219) to permit NLS to develop and distribute devices to be used for reading any format, including DAISY (Digital Accessible Information System). As part of these services and products offered, NLS loans free DTBMs for use in consuming NLS-produced audio materials. NLS-produced audio materials are distributed via NLS DTBM cartridges and data files online via Braille and Audio Reading Download (BARD) website in AMR-WB+, MPEG I/Layer 3 (MP3), RIFF WAV, and other audio formats.

NLS requires additional DA2 units, consistent with the existing inventory of NLS DA2 devices. NLS requires quantities sufficient to continue distribution to all audio readers enrolled in the program and maintain a reasonable stock to allow timely replacement of devices in the field to facilitate service, repair, or maintenance of removed devices. NLS also seeks non-recurring engineering services to support hardware upgrades of the DA2, spare parts, software development, and warranty repairs to support the new units. This is in line with NLS’ long-term effort to meet patron demand for the DA2 and audio access to the Library’s collections.

NLS also requires repair and support services for the existing HumanWare-manufactured NLS DTBM DA2 units (approximately 63,000). This includes spare parts and platform sprints to ensure the units remain safe, functional, and accessible so that the Library’s patrons have the fullest access to materials in the NLS collection. This also supports NLS’ long-term effort to meet patron demand for the latest generation of the NLS DTBM (model DA2). Support services, repairs, and parts are proprietary to HumanWare and therefore are only available from the manufacturer (see Attachment J4 – JA_HumanWare).

C.2. SCOPE

The Contractor shall provide the services and supplies described in one or more Performance Areas (PA) under section C.3. Given the proprietary nature of certain aspects of the requirement, some contractors may not be capable of fulfilling the requirements of Performance Area 2.

C.2.1. PERFORMANCE AREA 1: DTBM DA2 Production, Parts, and Support The contractor shall develop, manufacture, supply, and support DA2 units per Section C.3.1. This must ensure that:

1. The device shall meet or exceed the technical device and data requirements defined in Attachment J1 – DA2 Requirements.

2. A DA2 Technical Data Package (TDP) shall be provided and maintained.

3. Warranty repairs are available as needed.

4. All DA2 spare parts and components for device integrity, repair, and use are available and supplied as needed and ordered.

A. Performance Area 1: Manufacture and Supply of DA2 Units

1. Specifications: DA2 DTBM units shall adhere to all specific technical requirements outlined in Attachment J1 – DA2 Requirements. DA2 units will be procured via task order in exact quantities required.

2. Production and Manufacturing Plan: The contractor shall produce and deliver a finalized production and manufacturing plan for the DA2 for written approval and acceptance by the Contracting Officer’s Representative (COR) (see Section C.4.4 Deliverables Schedule). At a minimum, the plan shall include a program schedule, tasks, and milestones for fulfilling the requirements of this contract. The plan shall include detailed information on the production facility, equipment/tools used for assembly, quality-assurance procedures, and factory-acceptance tests. The contractor shall not begin mass production of DA2 units without approval by NLS of the manufacturing and production plan. The contractor must adhere to the plan throughout the life of the contract.

If engineering change plans or other in-scope production adjustments are made, the contractor must revise the plan and resubmit it for COR review and written acceptance.

3. Unit Delivery, Inspection, and Acceptance: When an order is placed, the contractor shall manufacture, conduct factory acceptance testing, and deliver the full quantity ordered to the identified location in Section F unless otherwise specified in the task order. All units in a task order must be delivered within 40 weeks of the task order start date. On receipt, NLS will sample a randomly selected lot of units the size of which will be in accordance with standard ANSI/ASQ Z1.4 and communicated by the COR based on total order size. If sample lots contain defects or issues, the COR will notify the contractor via email. Upon notice, the contractor must develop and provide a remediation plan to address the defects or issues. The remediation plan must be provided within 30 calendar days. The plan must coordinate with the COR to access or retrieve the entire production lot for remediation. On completion of remediation, the entire production lot must be returned to the identified location for additional random sample unit testing. If necessary, this process shall be repeated until all defects or issues are resolved. Once the sample lot is tested and found to have passed sample inspection, the COR will provide a written report of sample inspection results and acceptance of the delivered task order production lot.

4. DA2 DTBM Certifications: The contractor must obtain and maintain all product certifications required for the operation and sale of DA2 devices as a consumer product on the open market in the United States as a consumer electronic device.

B. Performance Area 1: Spare Parts for DA2 Devices

1. Supply: The contractor must provide spare parts for the field replacement of sub-assemblies or repair of damaged DA2 devices. Repairs will be completed by NLS or NLS partners. All parts are listed in Attachment J2 – Pricing Schedule – All Supplies and Services.

2. Delivery: All spare parts shall be delivered no later than 60 days after being ordered.

3. Parts Certifications: The contractor must obtain and maintain all product certifications required for the operation and sale of DA2 parts as consumer products on the open market in the United States as a consumer electronic device.

C. Performance Area 1: Non-Recurring Engineering

1. Planning and Performing NRE: The contractor may be required to perform the non-recurring engineering (NRE) described below to satisfy updated requirements for the DTBMs. NRE performed under contract shall only be in support of NLS deliverables. The Library will initiate NRE work via negotiated modifications with the contractor.

The contractor must provide an itemized quote and approach for performing the NRE, including the benefit of the NRE to the device, Library patrons, and commercial industry. No NRE shall commence or be performed without a fully funded and executed task order from the Contracting Officer. With the NRE quote, the contractor must also provide updated unit, part, and service pricing for deliverables in Attachment J2 that are affected by the change for the remainder of the contract. NRE engineering costs may be used to retool the manufacturing and software of the units.

2. IDIQ Modification: If NRE work is successfully completed and accepted via task order, the IDIQ will be unilaterally modified by the Contracting Officer to account for specification, parts, and/or pricing changes.

D. Performance Area 1: Engineering Change Control Process

1. Engineering Change Request (ECR) Submission: The contractor shall utilize an industry recognized engineering change control process. The current DA2 design reflected in the Attachment J1 is under engineering change control. Any changes to the current approved DA2 requirements during the performance of the contract must be proposed as an Engineering Change Request (ECR). The ECR must provide a detailed description of the proposed change and an analysis of the impact of the change. The ECR must also indicate testing to be performed to validate the success and efficacy of the change(s). No changes shall be performed or applied to the DA2 until the ECR is approved in writing by the COR.

2. ECR Performance, Sample, and Production: If an ECR is approved for implementation, such changes will require two new production control samples incorporating the changes to be tested and approved by NLS. NLS will provide acceptance or rejection of the ECR samples within 15 calendar days of receipt of the units at NLS facilities. Acceptance or rejection will be accompanied by an explanation of sample test findings and decision. At NLS’s discretion, the first 200 units manufactured after approval of the two production control samples shall be delivered to NLS (at an address specified by the COR) for inspection.

3. TDP: The contractor shall incorporate approved ECR in the Technical Data Package (TDP) and submit the revised TDP to the COR.

4. Rejection and Resolution: If the two production control samples, the first 200-unit submission, or any subsequent samples incorporating changes are rejected by NLS due to the contractor’s failure to produce acceptable units in accordance with the TDP, the contractor may, at the Library’s sole discretion, be given a reasonable time period within which to submit additional units for retesting by NLS. Within 30 days of notification of failed testing and request for additional units, the contractor must provide the COR a remediation plan. The COR must provide written acceptance of the remediation plan before any additional units are submitted for retesting. In this scenario, all associated costs of producing and shipping any such additional samples shall be borne by the contractor.

E. Performance Area 1: Technical Data Package (TDP)
