SECTION C - DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C. STATEMENT OF WORK
C.1 OVERVIEW / BACKGROUND
The Library of Congress (Library)’s Packard Campus Theater at the National Audiovisual Conservation Center (NAVCC) has a curtain and valance that are now approximately 17 years old and are exhibiting damage and mold. The Library requires contract support for an assessment of the condition of the curtain and valance. The assessment shall be followed by a report and recommendation for either curtain repair or curtain replacement so the Library may determine the preferred solution. The contractor shall complete the accepted recommendation of either repair or replacement.
C.2 SCOPE
The contractor shall perform an onsite assessment of the curtain and valance and provide a written report on its findings. Following the report, the Library, at its sole discretion, may exercise the option to clean and repair or to replace the curtain and valance.
C.3 REQUIREMENTS
The curtain and valance are on motorized tracks approximately 27 feet high. The current curtain consists of two panels, height 24’1”, width 28’0”. Valance measures 5’8” H x 34’0” W. Fabric type for both: DesignTex 387200248622, color Merlot. The curtain has a black liner. The offeror shall provide a proposal and quote for assessment plus both options.
The contractor shall field-verify all measurements.
3.1 CURTAIN ASSESSMENT
The contractor shall perform an onsite assessment of the curtain and valance at a mutually agreeable time and date which the Contracting Officer Representative (COR) will accept in writing. Prior to performing the assessment, the contractor shall present an assessment plan to the COR. The contractor’s assessment plan must include, at a minimum, the following:
What elevation method will be used (i.e. scaffolding, mechanical lift, ladders).
What equipment will be required and how the contractor will transport those items to and from the theater.
Precautions and risk mitigation efforts to prevent damage to movie screen, masking, carpet, stage, proscenium, and theater.
Contractor Personnel Safety Plan identifying potential safety hazards of work to be performed and risk mitigation tactics and procedures.
Number of contractor staff members required for work.
The COR will provide either feedback/revision requests or approval of the plan within five business days. If revisions are needed, the contractor must complete them and return the plan for COR approval within three business days. The assessment may proceed at the COR-approved date and time only after written approval of the assessment plan by the
COR.
3.2 POST ASSESSMENT REPORT
Following the assessment, the contractor shall provide a post-assessment report detailing the condition of the curtain and valance. This report must include a description of findings regarding the condition of the materials and mechanisms of the curtain and valance. Where possible, the report shall include photos to support the descriptions and findings.
The report must also include the contractor’s recommendation to either repair and clean the curtain and valance, or to completely replace the curtain and/or valance. This recommendation must be supported by the findings and photos and include enough information to exhibit a thorough assessment and consideration of the condition discovered. The report must include a draft project plan for execution of the contractor’s recommendation that includes, at a minimum, the information presented below in either Section 3.3 or 3.4, depending on the contractor’s recommended method of resolution. It is up to the Library to make the final determination on whether the curtain will be repaired or replaced based on the information the contractor provides and other factors the Library must consider before proceeding.
The contractor shall not perform any work to repair, clean, or replace any part of the curtain and valance without written authorization by the COR and an accompanying contract modification from the Contracting Officer (CO) exercising the option to perform the COR-approved work.
3.3 OPTION 1: CURTAIN AND VALANCE CLEANING AND REPAIR
The contractor shall clean and repair the curtain and valance to completely rid it of mold, dust, dirt, debris, other contaminants, rips, and tears. The method of cleaning must not impact the flame-retardant rating of the current fabric or significantly alter the appearance of the curtain. The curtain and valance must be cleaned and repaired at the contractor’s own facility. Before beginning the work, the contractor must present a complete cleaning and repair plan to the COR for review and written approval. The plan must include, at a minimum:
a. How the curtain and valance will be removed and transported to and from the theater.
b. Duration of time estimated for project completion.
c. Methods to be used, including:
i. Precautions to be taken by the vendor to prevent damage to the movie screen, masking, carpet, stage, proscenium, and theater.
ii. What equipment will be required and how will the contractor transport those items to and from the theater.
iii. What elevation method will be used for project completion (i.e. scaffolding, mechanical lift, ladders).
iv. If the contractor determines that rigging is necessary, the contractor’s cleaning and repair plan shall provide a rigging plan.
d. The Contractor Personnel Safety Plan must identify any potential safety hazards of work to be performed and risk mitigation tactics and procedures.
e. Number of contractor staff members required for work.
If any part of the curtain requires repair involving new fabric or materials, the new fabric and materials must be the same or equivalent to the existing fabric or materials in weight, flame retardant rating, and color. A swatch of the patch or replacement fabric/material and its specifications must be provided to the COR alongside the plan included in the post-assessment report recommendation and be approved, in writing, prior to its incorporation into the existing curtain.
The cleaned and repaired curtain and valance will be inspected prior to acceptance by COR and subject matter experts to ensure compliance with requirements and adherence to the cleaning and repair plan. Final approval authority lies solely with the COR. A second inspection will occur following reinstallation, when curtain surface will be fully visible. If cleaned/repaired condition is found to be unacceptable by the COR, the contractor will be required to correct and reinstall the curtain at no additional cost to the Library.
3.4 OPTION 2: CURTAIN AND VALANCE REPLACEMENT
The contractor shall remove, dispose of and replace the original curtain and valance.
The contractor shall present a plan to remove the current curtain and valance, install the new curtain and valance, and dispose of the original curtain and valance. The contractor’s plan shall describe the following:
a. Duration of time estimated for project completion.
b. Methods to be used, including:
i. Precautions to be taken to prevent damage to movie screen, masking, carpet, stage, proscenium, and theater.
ii. What equipment will be required and how the contractor will transport those items to and from the theater.
iii. What elevation method will be used for project completion (i.e. scaffolding, mechanical lift, ladders).
c. The Contractor Personnel Safety Plan must identify potential safety hazards of the work to be performed and risk mitigation tactics and procedures.
d. Number of contractor staff members required for work.
The curtain and valance shall be replaced with the same or similar fabric, which shall be equivalent or lighter weight and quality, equivalent flame-retardant rating, matching color, and feature a black liner. The contractor shall provide a swatch with the post-assessment report recommendation and specifications of any equivalent, similar, or recommended fabrics for approval by the COR in consultation with the Library.
The contractor must field-verify and confirm all measurements before replacing curtain and valance with the COR. The complete, replaced curtain and valance will be inspected after installation and prior to acceptance of the deliverables.
Inspection will be performed by the COR and subject matter experts to ensure compliance with requirements and adherence to the agreed-upon plan. Final approval authority lies solely with the COR.
3.5 EQUIPMENT
The contractor must provide all work equipment. The contractor shall schedule equipment deliveries in advance with the COR. Equipment deliveries must abide by the terms of LCFAR 52.211-1 Deliveries. Deliveries must occur during the Library’s loading dock hours of 8:00 a.m. to 4:00 p.m.

The Contractor, or any entity or representative acting on behalf of the Contractor, may not refer to the equipment or services furnished pursuant to the provisions of this contract in any news release or commercial advertising, or in connection with any news release or commercial advertising, without first obtaining explicit written consent to do so from the Contracting Officer. Should any reference to such equipment or services appear in any news release or commercial advertising issued by or on behalf of the Contractor without the required consent, the Government will consider institution of all remedies available under applicable law.
H.3 LC52.204-2 CONDUCT ON LIBRARY PREMISES (JUL 2021)
1. Access to Library buildings and grounds is governed by 36 C.F.R. part 702 - Conduct on Library Premises. Contractor staff must comply with these requirements and restrictions and related Library of Congress Regulations and Directives.
2. The Library is committed to preventing and addressing all forms of discriminatory harassment and to ensuring that Equal Employment Opportunity (EEO) principles are fundamental to Library culture. Everyone — employees, interns, volunteers, contractors, researchers, and visitors — is expected to help make the Library a respectful environment free from offensive behavior.
a. Library of Congress employees, contractors, interns, volunteers, researchers, patrons, and other visitors have a right to Library facilities that are free from discrimination based on their race, color, national origin, religion, sex, sexual orientation, gender identity, age (40 and over), disability, genetic information, union affiliation, political affiliation, or marital status.

(End of Clause)
H.4 LC52.204-4 CONTRACTOR EMPLOYEE FITNESS (SEP 2024)
“Contractor employee fitness” means fitness based on character and conduct for work for or on behalf of the Government as a contractor employee.
Work under this contract is unclassified. However, the Library of Congress shall conduct background investigations of contractor personnel who will have 1) regular, ongoing, unescorted access to the Library’s buildings, grounds, or collections, 2) access to Library information technology systems, and/or 3) access to Library information not available to the public, including information determined to be Controlled Unclassified Information (CUI), to ensure they meet basic standards of honesty and trustworthiness pursuant to Library regulations. The Library does not determine the fitness of employees to work for the contractor firm that hires them. The Library’s interest is in determining whether contractor personnel should be granted greater access than the general public to Library facilities, Library information technology systems, and/or non-public Library information.
(1) Any access to non-public Library facilities, Library information technology systems, and/or non-public Library information will require a contractor employee fitness determination. All initial, existing, and reciprocal contractor employee fitness determinations will be subject to continuous vetting. Continuous vetting will vary based on position risk level. An example of continuous vetting is outlined in Trusted Workforce 2.0 (https://www.performance.gov/trusted-workforce/ and https://www.dcsa.mil/Personnel-Security/Continuous- Vetting/).
(2) A favorable contractor employee fitness determination requires completion and successful adjudication of a security application request (release forms, fingerprints, and a full background investigation). To facilitate the fitness determination, the prospective contractor employee shall submit to the Library complete and accurate information as identified on the National Background Investigation Services (NBIS)’s eAPP (https://eapp.nbis.mil) or other system as provided by the Personnel Security Division (PSD). Contractors should anticipate a minimum of two weeks for the process, provided all requested information is timely, accurate and complete and that no adverse information is received. A background investigation generally will require that the candidate has cumulatively resided in the United States for at least three of the past five years. This requirement is subject to certain exceptions assessed on a case-by-case basis by PSD in accordance with established federal personnel vetting standards.
(3) After the contractor employee fitness determination, each contractor employee with a favorably adjudicated background investigation shall be enrolled in and subject to the Library’s continuous vetting process. Enrollment in the Library’s continuous vetting process also requires enrollment in the Federal Bureau of Investigation (FBI) Record of Arrest and Prosecution Background (“Rap Back”) program, which provides the Library with notification of any criminal activity by the enrollee. Upon enrollment in Rap Back, the Library shall provide each enrollee with a notification of their rights with respect to the collection and use of their fingerprints and to the accuracy of the information obtained from Rap Back, as well as a copy of the FBI Privacy Act Statement that describes how FBI may use their fingerprint images.
(4) The fact that the Library may conduct background investigations and continuous vetting on assigned contractor personnel does not relieve the contractor of the responsibility to provide qualified, reliable personnel of sound character and conduct. This includes providing contractor personnel who can maintain compliance with the Library’s requirement of a drug-free workplace and federal laws regarding controlled substances (see the Controlled Substances Act, 21 U.S.C.
§ 801 et seq. for the definition of controlled substances). In the event that drug testing is required for a contractor employee to obtain a favorable fitness determination, the contractor will be responsible for bearing the costs of such testing, conducting the testing in a manner consistent with federal vetting standards, which are based on the testing protocols published by the Substance Abuse and Mental Health Services Administration (SAMHSA), and providing the results to the Library.
(5) The Library may require removal of contractor staff from Library facilities and revocation of access to Library information technology systems and non-public Library information if investigative results raise concerns regarding a contractor employee’s fitness or the contractor employee is non-compliant with the Library’s instructions or requests for information during the vetting process. In such cases, the Contracting Officer (CO) or Contracting Officer Representative (COR) will notify the contractor of the unfit determination and need for the contractor employee to return all government equipment such as badges, keys and network tokens if issued. Contractor management staff may be required to escort the contractor employee from Library premises.
(6) The contractor will ensure the COR and CO are notified of all changes to those contractor personnel performing work on this contract that require non-public access.
(End of Clause)
H.5 LC52.204-5 IDENTIFICATION AND BUILDING PASSES (SEP 2024)
(a) The Contractor shall ensure that all contractor employees, both directly employed and subcontracted, contractors and sub-contractors, who will need regular, unescorted access to Library facilities obtain Library-issued photo identification badges. The Library will issue the ID badges without charge. The Contractor shall schedule with the COR time for contractor staff to be available to receive Library ID badges prior to starting work. The Contractor shall accurately maintain a list of contractor employee badge numbers and provide updates to the COR upon request.
(b) The Contractor shall provide instruction and ensure that each contractor employee performing work under this contract visibly displays their Library ID badge at all times they are present on-duty on Library premises. Refusal or repeated neglect to display the Library ID badge may result in removal from non-public Library premises and removal from the contract.
(c) Upon termination, resignation, contract completion, or other event leading to a contractor employee not requiring continued access to Library facilities under this contract, the Contractor is responsible for returning all Government identification, building passes, keys, and other Government property issued to that contractor employee within 5 business days from the termination of that contractor employee’s access. Failure on the part of the Contractor to return these materials may result in the Contractor’s liability for all costs associated with addressing the resultant security breach.
(End of Clause)
H.6 LC52.237-1 KEY PERSONNEL (AUG 2014)
The personnel designated as key personnel in this contract are considered to be essential to the work being performed hereunder. At least 30 days prior to diverting any of the specified individuals to other programs or contracts or as soon as possible if an individual must be replaced, for example, as a result of leaving the employ of the contractor, the contractor shall notify the contracting officer and identify proposed substitutions. No diversion or substitution shall be made by the contractor without written consent of the contracting officer.
The following personnel have been identified as Key Personnel in the performance of this contract:

The Contracting Officer may require removal from work on this contract any employee(s) that may be deemed incompetent, careless, insubordinate, unsuitable, or otherwise objectionable, or whose continued employment is deemed contrary to the public interest or inconsistent with the best interest of or the security of the Library.
