About this file
This document is a Questions & Answers response for solicitation 03020 - Lamps, Ballasts, Retrofit Kits and Lamp Recycling, issued by the Washington State Department of Enterprise Services. This statewide Master Contract is for eligible purchasers to acquire these products. The solicitation documents were recently revised to allow bidders to quote manufacturers that do not use "list price" or "published retail price" as their standard pricing. Bidders must list the manufacturer's "Alternate Pricing Index" on the updated Exhibit C-2, Sheet 3. If a manufacturer uses the term "list price" or "published retail price", bidders should use those terms without completing Sheet 3. The DES will verify the pricing terms and links provided by the winning bidders.
This solicitation does not include replacement fixtures, which were previously part of the scope. There are no specific requirements for LED Mogul based HID products or emergency ballasts, as the implied warranty and environmental restrictions will apply if not explicitly listed. The DES will make no distinction between standard and emergency ballasts, and bidders should quote them at the same percentage discount.

| Did this change the solicitation? |
-How will DES validate list price from each MFG?
-A follow up question would be, how will DES validate that a sell price to your customer was at the appropriate discount off of “list price”?
If a bidder quotes a manufacturer that does not use these terms for their standard price list, then they can list what it’s called on Exhibit C-2, Sheet 3. If a dealer quotes some other brand, then they list what their brand’s term is, whether it is “sticker price, MSRP, etc.”, and anyone else who quotes this brand should match. If they don’t, we (DES) will call the manufacturer to ask what the appropriate term is.
If the bidder quotes a manufacturer that uses the term ”list price” or “published retail price”, then that is the term they should use. Per the instructions on Exhibit C-1, they do not have to have to complete Exhibit C-2, Sheet 3 for “Alternate Pricing Index”. If the bidder uses a different term, they need to complete Exhibit C-2, Sheet 3 for “Alternate Pricing Index”.
After a manufacturer category has an official winning bid for manufacturers that use the terms ”list price” or “published retail price”, then the DES will require that the bidder provide the link to the pricing. If using an “Alternate Pricing Index” then DES will verify the link.
Yes
-On Exhibit B, there is no spec for LED Mogul based HID’s (listed on Exhibit C-2). Are there requirements for that product?
If there is no Underwriters Laboratories, Inc. (UL) Publications standard listed on Exhibit B for a category, then implied warranty applies. If a category listed on Exhibit C-2 does not list any Environmental Restrictions listed on Exhibit B, then none apply to that category.
No
-What are the requirements for ballasts and is there a separate category for emergency ballasts?
-If there is, what are the requirements for those as well?
There is only one category for ballasts as we are making no distinction between ballasts and emergency ballasts. You should quote as if you will be selling both at the same percentage discount.
If there is no Underwriters Laboratories, Inc. (UL) Publications standard listed on Exhibit B for a category, then implied warranty applies. If a category listed on Exhibit C-2 does not list any Environmental Restrictions listed on Exhibit B, then none apply to that category.
