About this file

This document is a Final Permit issued by the Florida Department of Environmental Protection (FDEP) to Walton County Public Works for the Mack Bayou Road Pedestrian Improvements Phase 1 project. The permit verifies exemption from regulatory requirements under Florida Administrative Code for activities including milling and resurfacing of Mack Bayou Road from Ascension Sacred Heart Hospital to East Harborview Road, roadway widening of 2 feet on the west side, and construction of an 8-foot wide multi-use trail. The project is located within FDOT-maintained rights-of-way along multiple roads in Mack Bayou, Santa Rosa Beach, in Walton County. The permit was issued on November 14, 2024, and remains valid through July 27, 2026. The exemption verification is based on compliance with Chapter 62-330.051(4)(c-d) and Chapter 62-330.051(10)(a-e) of the Florida Administrative Code, which address roadway resurfacing and recreational path construction. The applicant is Walton County Public Works, with Anna Hudson as the primary contact and Charles Cotton as co-applicant; Aaron Harrison of Halff Associates, Inc. serves as the agent.

The permit includes general conditions requiring that construction not adversely impound or obstruct water flow, cause impacts to minimum flows and levels, impede navigation, or contribute to violations of state water quality standards. Erosion and sediment control best management practices must be installed per the Florida Erosion and Sediment Control Designer and Reviewer Manual. When performed in waters accessible to federally or state-listed aquatic species such as manatees and marine turtles, all in-water work must comply with specific protocols including idle speed operations, siltation barrier maintenance, 50-foot approach restrictions, and immediate reporting of any killed or injured species to the Florida Fish and Wildlife Conservation Commission. The permit notes that separate authorization from the U.S. Army Corps of Engineers or FDEP may be required, and that federal water quality certification is waived for exempt activities. The project activities must be completed by July 27, 2026, and the department reserves the right to inspect activities at any time to ensure compliance with applicable statutes and administrative codes.

Dear Ms. Hudson:

On October 2, 2024, we received your request for verification of exemption to perform the following activities:

To perform the milling and resurfacing of Mack Bayou Road from Ascension Sacred Heart Hospital to East Harborview Road, including the widening of the west side of the roadway by 2-ft and the modification of existing headwall extensions (Permit No. 0453753-001-EE/66). The roadway widening will incorporate the construction of an 8-ft wide multi-use trail for the first half of the project, the remaining length of the multi-use concrete path will run adjacent to the highway (Permit No. 453753-002-EE/66). The project is located within FDOT maintained rights-of-way along Driftwood Point Rd, W & E Shipwreck Rd, W & E Harborview Rd, and Mack Bayou Road in Mack Bayou, Class II Florida Waters, Mack Bayou Road/US Highway 98 W, Santa Rosa Beach, Section 24, Township 2 South, Range 21, Walton County.

Your request has been reviewed to determine whether it qualifies for (1) regulatory exemption,

(2) proprietary authorization (related to state-owned submerged lands), and (3) federal approval that may be necessary for work in wetlands or waters of the United States.

Your project did not qualify for the federal review of this verification request. Additional authorization may be required prior to commencement of the proposed activity. This letter does not relieve you from the responsibility of obtaining other federal, state, or local authorizations that may be required for the activity. Please refer to the specific section(s) dealing with that portion of the review below for advice on how to proceed.

State water quality certification is waived for activities that are exempt under rule 62-330.051, F.A.C.

If you change the project from what you submitted, the authorization(s) granted may no longer be valid at the time of commencement of the project. Please contact us prior to beginning your project if you wish to make any changes.

If you have any questions regarding this matter, please contact Chris Bickham at the letterhead address or at 850-595-0607 and Chris.Bickham@FloridaDEP.gov.

1. Regulatory Review –Verified Based on the information submitted, the Department has verified that the activities as proposed are exempt, under Chapter 62-330.051(4)(c-d), Florida Administrative Code and Chapter 62- 330.051(10)(a-e), Florida Administrative Code from the need to obtain a regulatory permit under Part IV of Chapter 373 of the Florida Statutes.

This exemption verification is based on the information you provided the Department and the statutes and rules in effect when the information was submitted. This verification may not be valid if site conditions materially change, the project design is modified, or the statutes or rules governing the exempt activity are amended. In the event you need to re-verify the exempt status for the activity, a new request and verification fee will be required. Any substantial modifications to the project design should be submitted to the Department for review, as changes may result in a permit being required.
