About this file
The document is a Florida Department of Environmental Protection (FDEP) permit verification letter for Walton County Public Works, specifically addressing the Mack Bayou Road Pedestrian Improvements Phase 1 project. The permit (File Nos. 0453753-001-EE/66 and 0453753-002-EE/66) verifies exemption for milling and resurfacing Mack Bayou Road from Ascension Sacred Heart Hospital to East Harborview Road, including roadway widening and construction of an 8-foot multi-use trail. The project spans approximately 2 miles along Mack Bayou Road in Santa Rosa Beach, with the trail running adjacent to the highway for part of the route. The permit was issued on November 14, 2024, and includes exemptions from regulatory permitting under specific Florida Administrative Code provisions.
The project is exempt from state water quality certification and does not require federal review. The permit outlines specific conditions, including requirements for erosion control, protection of aquatic species, and maintenance of water quality standards. The contractor must implement best management practices for sediment and erosion control, including temporary seeding, inlet protection, and silt fence installation. The project has a contract duration of 180 days for substantial completion, with an additional 30 days for punch list items. The total project length is approximately 10,845 linear feet, starting near Monarch Drive and ending at Harborview Road, and involves milling, resurfacing, and constructing a multi-use pedestrian path.

Dear Ms. Hudson:
On October 2, 2024, we received your request for verification of exemption to perform the following activities:
To perform the milling and resurfacing of Mack Bayou Road from Ascension Sacred Heart Hospital to East Harborview Road, including the widening of the west side of the roadway by 2-ft and the modification of existing headwall extensions (Permit No. 0453753-001-EE/66). The roadway widening will incorporate the construction of an 8-ft wide multi-use trail for the first half of the project, the remaining length of the multi-use concrete path will run adjacent to the highway (Permit No. 453753-002-EE/66). The project is located within FDOT maintained rights-of-way along Driftwood Point Rd, W & E Shipwreck Rd, W & E Harborview Rd, and Mack Bayou Road in Mack Bayou, Class II Florida Waters, Mack Bayou Road/US Highway 98 W, Santa Rosa Beach, Section 24, Township 2 South, Range 21, Walton County.
Your request has been reviewed to determine whether it qualifies for (1) regulatory exemption,
(2) proprietary authorization (related to state-owned submerged lands), and (3) federal approval that may be necessary for work in wetlands or waters of the United States.
Your project did not qualify for the federal review of this verification request. Additional authorization may be required prior to commencement of the proposed activity. This letter does not relieve you from the responsibility of obtaining other federal, state, or local authorizations that may be required for the activity. Please refer to the specific section(s) dealing with that portion of the review below for advice on how to proceed.
State water quality certification is waived for activities that are exempt under rule 62-330.051, F.A.C.

1. Regulatory Review –Verified Based on the information submitted, the Department has verified that the activities as proposed are exempt, under Chapter 62-330.051(4)(c-d), Florida Administrative Code and Chapter 62- 330.051(10)(a-e), Florida Administrative Code from the need to obtain a regulatory permit under Part IV of Chapter 373 of the Florida Statutes.
This exemption verification is based on the information you provided the Department and the statutes and rules in effect when the information was submitted. This verification may not be valid if site conditions materially change, the project design is modified, or the statutes or rules governing the exempt activity are amended. In the event you need to re-verify the exempt status for the activity, a new request and verification fee will be required. Any substantial modifications to the project design should be submitted to the Department for review, as changes may result in a permit being required.

2. The work does not realign the road or expand the number of traffic lanes of the existing road, but may include safety shoulders, clearing vegetation, and other work reasonably necessary to repair, stabilize, pave, or repave the road, provided that the work is constructed using generally accepted roadway design standards;
3. Existing bridges are not widened more than is reasonably necessary to properly connect the bridge with the road to match the width of the roadway travel lanes and safely accommodate the traffic expected;
4. No debris from the original bridge shall be allowed to remain in wetlands or other surface waters;
5. Roadside swales or other effective means of stormwater treatment are incorporated as part of the work;
6. No more dredging or filling of wetlands or water of the state is performed than is reasonably necessary to perform the work in accordance with generally accepted roadway design standards;
