About this opportunity
The Commonwealth of Kentucky Finance and Administration Cabinet, on behalf of the Division of Waste Management, seeks qualified vendors to establish a Master Agreement for Soil Analysis Services through Request for Bid (RFB 758 2300000313-5). The procurement encompasses three primary line items: analysis of approximately 300 field samples and trip blanks annually, shipping charges for 30 annual shipments, and provision of 300 passive sub-soil vapor phase sampling (PSG) devices. Vendors must be National Environmental Laboratory Accreditation Program (NELAP) certified and demonstrate capability to analyze passive soil-gas samples using EPA Method 8260C or TO-17 for 24 specified volatile organic compounds including vinyl chloride, trichloroethene, tetrachloroethene, benzene, toluene, and naphthalene. Deliverables include electronic analytical reports submitted within 15 business days of sample receipt containing narrative summaries with quality assurance/quality control program documentation, laboratory data in units of ug/m3, chain of custody documentation, and optional color isopleth maps. PSG samplers must fit within pre-drilled 1-inch diameter drill holes and include detailed sampling instructions, trip blanks, collection containers, and specialized insertion tools. The vendor is responsible for all shipping costs via FedEx with appropriate hazardous material packaging to and from the Division of Waste Management at 300 Sower Boulevard, 2nd Floor, Frankfort, Kentucky 40601. Award will be made on a best value basis with pricing weighted at 90 points (lowest bidder receives maximum points) and years of experience weighted at 10 points, requiring vendors to demonstrate a minimum of 15 years of experience with specified EPA methods. The initial contract period is one year from the award date, with four optional one-year renewal periods available subject to written approval and potential renegotiation. The bid closing date is December 13, 2022, at 1:30 p.m. ET, with all submissions required electronically through the Kentucky eProcurement system; written vendor questions were due by December 1, 2022, at 10:00 a.m. ET.
Kentucky resident bidders are eligible for reciprocal preference equal to preferences given by the bidder's state of residency, and qualified bidders receive additional point preferences including Kentucky Correctional Industries (20 percent preference), Kentucky Industries for the Blind, and qualified nonprofit agencies serving individuals with severe disabilities (15 percent preference). All pricing must be quoted F.O.B. Destination Freight Prepaid and Allowed, excluding federal excise tax and Kentucky sales or use tax, with prices remaining firm for a minimum of 60 calendar days after the bid due date. Price increases are prohibited during the first 12 months of the contract; thereafter, increases may be requested with 30 days' written notice and documented justification based on industry-wide price changes subject to Commonwealth approval. Prior to contract award, successful bidders must register in the Commonwealth eProcurement System, complete Kentucky Tax Registration Application Form 10A100, and submit required affidavits including annual affidavits certifying compliance with Kentucky campaign finance laws, proper disclosure of information, current registration with the Kentucky Department of Revenue, and non-delinquency on state taxes and fees. The Request for Bid documents do not specify an estimated contract value or budget range for this Master Agreement procurement. All bids must be responsive to all line items, and responses not conforming to specifications will be deemed non-responsive; the Commonwealth reserves the right to cancel the solicitation if responses exceed available funding and may extend the resulting Master Agreement to other state agencies with vendor consent.
