About this opportunity

The Commonwealth of Kentucky, through the Finance Division of Engineering and Contract Administration on behalf of the Justice Cabinet's Division of Criminal Justice Training (DOCJT), is procuring two (2) centrifugal water chillers with a nominal cooling capacity of 255 tons each for the Law Enforcement Training Center in Richmond, Kentucky. The procurement solicitation (RFB-58-19) seeks sealed bids for the pre-purchase and delivery of these refrigeration units, with installation to be performed under a separate contract. Each chiller must be a centrifugal compressor machine operating at 460 volts/3 phase/60 Hz with either conventional oiling or magnetic-bearing oil-less design, featuring evaporators and condensers rated for 612 and 1,068 gallons per minute water flow rates respectively. The chillers must comply with Kentucky Building Code, AHRI Standard 550/590, ASHRAE standards, and ASME Boiler and Pressure Vessel Code requirements, with approval from Underwriter's Laboratories or equivalent testing agencies. Deliverables include comprehensive product data, submittal drawings, wiring diagrams, five bound operation and maintenance manuals, factory acceptance testing witnessed by the owner's representative, and a five-year parts and labor warranty commencing upon substantial completion, along with a five-year maintenance agreement comprising minimum three eight-hour inspections annually. The award will be made to the responsive and responsible bidder with the lowest Total Plant Modified Life Cycle Cost, calculated using the base bid price plus twenty-year present worth of estimated annual electrical consumption costs at 6% interest rate. Bids were originally due September 6, 2018, but Addendum No. 1 extended the deadline to September 18, 2018, at 10:30 a.m. Eastern Time, with sealed bids to be submitted to the Sealed Bid Clerk at 403 Wapping Street, 2nd Floor, Frankfort, Kentucky 40601-2638. Bidders must submit sworn affidavits certifying compliance with Kentucky campaign finance laws, worker's compensation and unemployment insurance requirements, Kentucky Department of Revenue registration, non-debarment status, and conflict-of-interest compliance, along with a Vendor Report of Prior Violations for the preceding five years.

Kentucky resident bidders are eligible to claim reciprocal preference under KRS 45A.490-494, and the Commonwealth may provide additional preferences for Kentucky-qualified bidders or the Department of Corrections, Division of Prison Industries, with bidders claiming resident status required to submit a Required Affidavit for Bidders, Offerors, and Contractors Claiming Resident Bidder Status. Nonresident bidders must submit their certificate of authority to transact business in Kentucky from the Secretary of State and must be registered with the Kentucky Secretary of State and eMars within five days of notification, with foreign entities required to produce a certificate of authority within fourteen days of bid opening or face disqualification. All bids must be accompanied by a bid guarantee of not less than five percent of the lump sum base bid in the form of a bid bond or certified check, and the successful bidder will be required to furnish 100% Performance and Payment Bonds. The project involves delivery F.O.B. truck bed at 521 Lancaster Avenue, Richmond, Kentucky, with a projected delivery date of March 1, 2019, and complete installation and startup scheduled for April 15, 2019; vendors are required to visit the project site before submitting bids and provide at least three weeks advance notice of shipping details. Payment is structured at 90 percent of total purchase price upon delivery and acceptance, with 10 percent retained until final completion; liquidated damages are assessed at $2,500 per day for late delivery and $1,000 per day for late final completion. The contract price includes all expenses for factory performance testing and must account for the Commonwealth's exemption from Kentucky sales tax and federal excise tax. While no specific budget or award value is disclosed in the solicitation documents, the vendor must provide a comprehensive five-year warranty and maintenance agreement with on-site factory-trained service engineer support, three annual site visits during the warranty period, and full coverage of all materials, parts, refrigerant, and labor costs.
