About this opportunity
The Commonwealth of Kentucky Finance and Administration Cabinet, on behalf of the Department of Agriculture, seeks qualified vendors to provide removal, packaging, labeling, transportation, and disposal services for agricultural chemical pesticides through EPA-approved incineration facilities. The procurement encompasses two primary line items: removal and disposal of approximately 40,000 pounds of concentrated agricultural chemical pesticides and 40,000 pounds of non-hazardous pesticide rinse water annually, with services conducted at approximately 180-calendar-day intervals (May and November). Materials will be managed from the primary storage site at the Marshall County Landfill Facility in Benton, Kentucky, and potential satellite sites throughout the Commonwealth. Vendors must maintain a minimum inventory of 90 combined 55- and 85-gallon over-pack drums and possess capability to handle old, unused, canceled, banned, discontinued, and unknown pesticide wastes while ensuring all removal and incineration is completed within 30 calendar days of notification, with penalties of 1% per day deducted from invoices for non-compliance. The solicitation (RFB 758 2400000785) requires electronic submission through Kentucky's eProcurement system with a final closing date of July 26, 2024, at 1:30 p.m. ET; vendor written questions were due July 1, 2024. Award determination will utilize a best-value approach based on a 100-point evaluation system comprising 90 points for price (with the lowest bidder receiving maximum points) and 10 points for years of experience in pesticide removal services within the United States, with a maximum of 50 years considered. Bidders must submit all line items to be considered responsive, maintain pricing validity for 60 calendar days post-bid, and provide pricing on an F.O.B. Destination Freight Prepaid and Allowed basis, with no price increases permitted during the first 12 months and subsequent increases requiring documented industry-wide justification submitted 30 days in advance.
Kentucky resident bidders may receive reciprocal preference against nonresident bidders in accordance with Kentucky Revised Statutes 45A.492-494, and qualified bidders including Kentucky Industries for the Blind and certain nonprofit agencies for individuals with severe disabilities may receive preference equal to 15 percent of maximum points, with the latter required to employ at least 75 percent individuals with severe disabilities for direct labor hours. Prior to contract award, successful bidders must submit a Kentucky Tax Registration Application (Form 10A100), Certificate of Authority for foreign entities, required affidavits attesting compliance with Kentucky campaign finance laws and resident bidder status, and proof of insurance including Commercial General Liability coverage of $1,000,000 per occurrence and $2,000,000 aggregate with the Commonwealth listed as additional insured, plus Automobile Liability Insurance of $1,000,000 combined single limit for vehicles used in contract performance. The contract will be awarded for an initial one-year period with four optional one-year renewal periods, subject to written approval and potential renegotiation of terms. Based on the most recent contract for these services (MA 758 1800000720), the estimated annual spend ranges from $25,000 to $30,000. Vendors must comply with all EPA, Kentucky Department of Agriculture, Kentucky Department of Natural Resources, and Kentucky Transportation Cabinet regulations, maintain comprehensive record-keeping and manifesting documentation, and bear full responsibility for any penalties or fines resulting from noncompliance.
