Scope of Contract A Master Agreement for Pesticide Removal and Disposal Services for the Kentucky Department of Agriculture.
Performance Specifications
The vendor shall provide all materials, supplies, equipment and labor to package, label, and transport for incineration to an EPA approved facility, at approximately 180 calendar day intervals: Concentrated Agricultural Chemical Pesticides and Non-Hazardous Pesticide Rinse Water. .
https://finance.ky.gov/eProcurement/Pages/procurement-laws-regulations-and-policies.aspx https://finance.ky.gov/eProcurement/Pages/procurement-laws-regulations-and-policies.aspx https://finance.ky.gov/eProcurement/Pages/doing-business-with-the-commonwealth.aspx
The vendor will be handling old, unused, canceled, banned and discontinued waste. The contractor shall also be required to handle some quantities of unknown pesticide wastes. An attempt will be made by KDA personnel to identify the unknown wastes based upon information provided by the farm owner or appropriate representative. All pesticide wastes will be designated Universal Wastes-Pesticides and shall be shipped on a hazardous bill of lading. Most pesticide wastes will be in the original manufacturer’s container. All potential leaking containers will be poly-bagged. We need closed steel drums with two-piece tops. All the Universal Waste will be over-packed in vermiculite within 85-gallon over-pack drums or 55-gallon over-pack drums. Pressurized cylinders, aerosol products or fumigants will not be handled unless special conditions arise. The contractor will be required to send back the used 55/85-gallon over-packs in good condition (not rusted, punctured or severely dented) or like containers. The chemical is left in original containers and placed inside of the 8MIL thick liner in the 55- or 85- gallon drums. It is not in bulk liquid.
Vermiculite absorbent is used inside of the liner that contains the liquids in case of spillage. The absorbent and the drum liners are furnished by the Kentucky Department of Agriculture.
In some instances, the vendor will be required to remove and dispose of Non-Hazardous Pesticide Rinse Water. Materials removed and disposed of in this classification will consist of Agricultural Pesticides that have been diluted by the addition of water. The Kentucky Department of Agriculture is responsible for putting the chemical containers in the drums. It is not in bulk waste, the chemicals are left in their individual containers.
The over-packs can be returned the next 180-day interval, unless special circumstances require immediate replacement. The KDA requires minimum of (90) 55/85-gallon over-packs to be in its possession at all times. Currently, the KDA has approximately 65-80 reputable over-pack drums in its possession or the current contractor’s possession.
A. Storage Site Locations:
Universal-wastes will generally be located at a Primary Storage Sites (PSS):
PSS: Western Kentucky site referred to as the Environmental Resources Center, Division of Environmental Services, at the Marshall County Landfill Facility, 835 Benton-Briensburg Road, Benton, Kentucky, 42025.
In addition to the PSS, there may be Satellite Sites (SSs) (single farm locations) where pesticide wastes are stored due to environmental conditions. Under these instances, the KY Department of Agriculture (KDA) personnel lack the proper equipment and/or expertise to remediate the pesticide waste. The cost of removal from the SSs, if there are any, shall be included in the unit price. Vendor must submit their bid price in accordance with agency specifications in the RFB.
When necessary, KDA coordinators will contact the vendor concerning any satellite sites to make arrangements for pick-up and disposal of pesticides at 180 day intervals. Detailed descriptions of these sites and the assistance of the regional coordinators will be available during the development of the manifest, pick-up, cataloguing, and the loading process, as needed, to the vendor. Regional coordinators will be on-call to answer the vendor’s questions and concerns as needed. Due to the nature of satellite sites, it is not possible to provide locations of these sites prior to contract award; however, all bidders are hereby notified that it may be necessary for the vendor to pick up large quantities of pesticides from a satellite site anywhere within the Commonwealth should such a site be identified.
The KDA Environmental Resources Center has restrictive access to the storage buildings;
therefore, the vendor must coordinate pick-up of waste with the availability of the designated KDA coordinators. All storage site locations can be availed by any large transport truck, i.e., tandem-axle tractors with standard-sized trailers. The truck must be equipped with a hydraulic lift gate, due to inaccessibility of fork lift.
B. Estimated Pesticide Waste Per Primary Site:
Western Kentucky/KDA Environmental Resource Center:
a. *Summer/Fall – estimated weight of pesticides accumulated = 10,000 pounds.
b. *Winter/Spring - estimated weight of pesticides accumulated = 10,000 pounds.
i. Total estimated weight per year is 40,000 pounds.
C. Calculation of Net Poundage:
Total weight and number of over-pack drums and pails will be provided to the vendor prior to each scheduled pick-up at the PSS and SS locations.
Total net-poundage of pesticide waste will be used to compute amount to be invoiced/paid to the vendor. Net-poundage will be determined by subtracting the vendor’s waste transport vehicle(s)’s empty (tare) weight from the loaded (gross) weight. This figure equals the net weight. Each weigh-in will occur at the same state certified scale to be determined by KDA personnel. KDA personnel will verify both the tare and gross weights. The net weight will determine the total payment to the vendor. The weight of the 55/85-gallon over-pack drums provided by KDA will be deducted and not be included in the final net weight).
D. Container Replacement:
Each over-pack container furnished by the KDA which has to be removed from PSS or SS sites shall be replaced with like over-pack containers by the vendor before the removal process is completed.
Replacement over-pack drums must be clean, shall not be rusted, contaminated or severely dented. In order for the vendor to know beforehand the number of over-pack containers to be used for replacements, the KDA will provide an approximate number of each size and type of over-pack container that will be needed to replenish over-pack container inventory for the KDA.
The KDA must maintain a minimum of (90) 55/85-gallon over-pack drums in new or usable condition.
The current inventory is approx. 65-85 over-pack drums of 85 & 55.
E. Record-keeping Forms:
Completion and submission of all record-keeping forms as required by the United States Environmental Protection Agency, the KDA, the KY Department of Natural Resources, as well as other appropriate federal, state, foreign and local agencies are the sole responsibility of the vendor. This includes all paperwork required by the generator to be initiated and submitted. All paperwork and record-keeping requirements, notices, etc. must be completed accurately and submitted on a timely basis. The vendor shall pay any resulting fines and/or penalties, legal fees, or other charges by any appropriate governmental regulatory agency issued against the KDA, resulting from a failure of the vendor to comply with this requirement.
The vendor shall provide the KDA, within 10 business days, if possible, of each pesticide waste pick-up, a FINAL Certificate of Disposal (COD) for the total poundage and each drum of wastes disposed-of under the resulting contract. Separate CODs shall be submitted for any pick-ups made at satellite sites. The vendor shall notify the Agriculture Branch Manager, Division of Environmental Services, of the number of COD forms required to be completed for each scheduled pick-up. Completed CODs shall be in a format that is easy to understand and quantify.
Removal, transportation and final disposal shall be completed according to KDA, EEC and KYTC regulations and requirements and proof of such must be provided to KDA before payment will be made.
A copy of all record-keeping forms must be furnished to the KDA. All forms shall be checked thoroughly by the vendor and KDA personnel. Errors or omissions on any form, report, permit, manifest, notice, etc. that are made by the vendor and are not corrected by the vendor within 15 calendar days of notification of the error by a KDA representative may lead to termination of the contract, as allowed and in accordance with 200 KAR 5:312. The vendor shall be responsible for all costs associated with correcting any errors or omissions.
F. Bill of Lading:
The vendor shall both obtain the signature of an authorized KDA representative and provide a copy of the completed bill of lading to the KDA before exiting each storage site (PSS and SS).
G. Removal and Incinerated Disposal Time:
Removal and Incinerated Disposal within thirty (30) calendar days of notification by KDA is required, but sooner is requested.
The vendor agrees that when Removal and Incinerated Disposal is not made within the contracted due date, one percent (1%) per day will be deducted from the vendor’s invoice for each day the vendor fails to meet the contracted disposal.
H. Pick-up and Disposal Dates:
Pesticide wastes located at the PSS and SS shall be removed and properly disposed of within 30 calendar days of award of the new contract. The next removal period shall occur at no more than 180 calendar days from the previous pick-up and disposal date. In other words, the KDA will require that pick-up and disposal of waste at each designated location occur on or before May and November of each year. These dates are subject to change year to year based upon negotiations between the KDA and the vendor.
I. Pesticides Not Eligible for Incineration:
Each bidder shall describe, on company letterhead, the waste management disposal process, as regulated by the EPA, to be utilized for pesticides that are not eligible for incineration due to the chemical make-up of those products.
**The vendor shall provide a Final Certificate of Disposal (COD) for pesticides that cannot be incinerated to prove that the products have been properly and finally disposed of in accordance with KDA, EEC and KYTC regulation and requirements for pesticide transport and disposal before payment will be made.

An evaluation committee, or a designated individual, will evaluate the information provided by the vendor in response to the established measurable criteria contained in the solicitation.
Measurable Criteria:
Price 90 Points
Years of Experience 10 Points
TOTAL POINTS 100 Points
Each vendor is responsible for submitting all relevant, factual and correct information with their offer to enable the evaluator(s) to afford each vendor the maximum score based on the available data submitted by the Vendor.
A bidder shall submit one (1) response to a solicitation and shall not propose more than one (1) model/brand for each item listed in the solicitation, except for requested tier pricing. Multiple or alternate bids offering more than one (1) bid price in total or by line item shall be rejected.
Vendors responding with the minimum Best Value requirements in this solicitation shall not be credited with Best Value points. Vendors responding with greater than the minimum requirements shall receive Best Value points. Failure to provide adequate information will impact the evaluated points awarded to the vendor.
A. PRICE (90 points)
The bidder with the lowest Price receives the maximum score. The bidder with the next lowest Price receives points by dividing the lowest Price by the next lowest price and multiplying that percentage by the available points. For example, 90 points is allocated to the lowest Price criteria for this procurement, bidder “A” bids $3.00 as the lowest bidder and receives the maximum 90 points ($3.00 / $3.00 = 1.00 x 90 = 90). Assume bidder “B” is the next lowest bidder at $4.00, then “B” receives 67.5 points ($3.00 / $4.00) = .75 x 90 = 67.5).
B. EXPERIENCE (10 points)
The bidder shall clearly state the number of years of experience for this procurement.
The bidder with the greatest number of years of experience (not to exceed 50 years for evaluation purposes) receives the maximum number of points. The bidder with the next largest number of years of experience, receives points by dividing the next largest number of years of experience by the largest number of years of experience and multiplying that percentage by the available points. For example, 10 points is allocated to the largest number of years of experience, over ten (10) years, for this procurement, bidder “A” bids 20 years as the bidder with the largest number of years of experience and receives the maximum of 10 points (20 / 20 = 1.00 x 10 = 10).
Assume bidder “B” is the bidder with the next largest number of years of experience at 15 years, then “B” receives 7.5 points (15 / 20) = .75 x 10 = 7.5).
Vendor should enter number of years of experience in the comments section of their online bid.
Experience should only include experience within the United States.
The Commonwealth reserves the right to require documentation verifying number of years licensed.
Best Value scoring is subject to Reciprocal preference for Kentucky resident bidders and Preferences for a Qualified Bidder or the Department of Corrections, Division of Prison Industries
