About this file
This document is an Affidavit Requirements and Instructions file for the Commonwealth of Kentucky, outlining mandatory attestations required from bidders, offerors, and contractors seeking state contracts. The affidavit is effective for one year from the date of execution and must be completed by an authorized representative of the contracting party, notarized, and submitted to the Commonwealth prior to contract award or renewal. The document provides three separate affidavit templates: (1) a Required Affidavit for Bidders, Offerors and Contractors attesting that the entity has not knowingly violated Kentucky campaign finance laws; (2) a Resident Bidder Status Affidavit requiring attestation that the bidding entity is authorized to conduct business in Kentucky, has filed corporate income taxes for the prior year, maintained unemployment insurance contributions, and held an active workers' compensation policy; and (3) a Qualified Bidder Status Affidavit for nonprofit organizations or qualified nonprofit agencies for individuals with severe disabilities, with specific requirements including 75 percent employment of individuals with severe disabilities for direct labor hours in manufacturing or provision of listed products or services.
Each affidavit must be executed under penalty of perjury by a duly authorized representative and notarized, with the bidding agency retaining the right to request updated affidavits and supporting documentation at any time. Failure to provide requested documentation upon request may result in bidder disqualification or contract termination. The Commonwealth reserves discretionary authority to verify all claims of resident bidder status or qualified bidder status and enforce compliance throughout the contract term. These requirements are established pursuant to Kentucky Revised Statutes 45A.110, 45A.115, and 45A.494, as well as applicable Kentucky Administrative Regulations.
