About this opportunity

The West Virginia Department of Environmental Protection (WVDEP), Office of Special Reclamation, is soliciting bids through Agency Request for Quote (ARFQ) ARFQ DEP2600000034 for construction and mine reclamation services at the Erun Coal Sales Inc site (U-4010-08) located in McDowell County near Panther, West Virginia. This fixed-period construction contract requires completion within 180 calendar days from the notice to proceed and encompasses comprehensive site reclamation work including mine bench regrading (10,360 cubic yards of cut material), mine seal installation (one wet seal and four dry seals with 75 linear feet of 12-inch discharge piping), main hollow channel construction (388 linear feet), road ditch construction (595 linear feet), pond diversion construction (187 linear feet), silt fence installation (2,100 linear feet), site preparation and erosion control measures, and revegetation of approximately 4 acres. The project requires contractors to secure and utilize an off-site borrow area providing a minimum of 4,703 cubic yards of acceptable fill material, perform all temporary facilities and utility coordination, maintain existing access roads in equal or better condition than pre-mobilization baseline, and submit comprehensive submittals including construction schedules, shop drawings, weekly construction reports, and final as-built plans in AutoCAD format. All bids must be submitted electronically through wvOASIS Vendor Self Service by November 12, 2025, at 10:30 a.m., with a mandatory pre-bid meeting scheduled for October 28, 2025, at 10:00 a.m. at the project site (attendance is required or bidders face disqualification), a technical question deadline of November 4, 2025, at 4:00 p.m., and bid line items structured as lump-sum pricing for mobilization/demobilization, construction layout, site preparation, quality control, and road maintenance, with unit pricing (per linear foot, per acre, per cubic yard, per ton, and per each) for remaining items. Qualification requirements include West Virginia contractor licensing, submission of a 5% bid bond, 100% performance bond, and 100% labor/material payment bond prior to contract award, commercial general liability and automobile liability insurance with minimum limits of $2,000,000 per occurrence (or $1,000,000 for contracts valued at $25,000 or less), compliance with federal and state law including Davis-Bacon wage rate exemption, maintenance of a drug-free workplace policy, and proof of no outstanding state debt, workers' compensation delinquency, or federal/state debarment.

The solicitation contains no designated set-asides for disadvantaged enterprises, minority-owned businesses, or other protected classifications, and all vendors are subject to equal competitive bidding requirements under West Virginia's competitive bidding laws and Freedom of Information Act disclosure provisions. For construction contracts exceeding $500,000, a 75% local labor market hiring requirement applies, and for contracts exceeding $250,000, contractors must submit a certified subcontractor list; this procurement also requires preference for domestic steel, aluminum, and glass products where applicable. No incumbent contractor is identified in the solicitation documents, and the project does not specify integration with existing infrastructure or technology systems beyond standard utility coordination through WV 811 and compliance with applicable AASHTO, ASTM, AWWA, and West Virginia Department of Transportation specifications. The contract structure provides for both lump-sum and unit-price compensation, with liquidated damages assessed at $1,000 per working day for delays beyond the 180-day completion deadline (excluding winter shutdowns or approved extensions), and final payment withheld until work is deemed substantially complete and acceptable by the Engineer, with a one-year warranty period required from final inspection. The solicitation documents do not specify a total contract value, budget range, or estimated award amount; pricing for each line item is to be provided by individual bidders during the submission process through the wvOASIS system, with questions directed to Linda L. Stanley, Buyer, at (304) 414-1144 or linda.l.stanley@wv.gov.
