About this opportunity

The State of Utah Division of Purchasing, conducted by the Division of Oil, Gas and Mining, is soliciting bids under IFB JH27-130 for the Hardscrabble Refuse Reclamation Project, which reclaims an abandoned coal refuse pile in Carbon County, Utah. A mandatory site visit and pre-bid meeting is set for November 13, 2026 at 10:00 a.m., and bids are due December 1, 2026. Attendance at the entire meeting is required to bid, and bids from firms not on record as attending the full session are nonresponsive.

Scope covers coal refuse excavation and haul, channel construction, site grading and earthwork, runoff control, revegetation of disturbed areas, and road realignment and resurfacing. The bid schedule itemizes mobilization, demolition, borrow and fill, channel and tributary work, drainage, road improvements, and revegetation, with unit and lump-sum pricing entered in an Excel spreadsheet. The Engineer's Estimate is $7.68 million, the contract runs 84 calendar days from notice to proceed, and award goes to a single lowest-cost responsive and responsible vendor meeting specifications and mandatory minimums.

Bidders must document completion as prime contractor of at least two projects within the past ten years, each valued at $2 million or more, with at least one completed within five years that included mine reclamation, coal refuse removal, riprap channel construction, or comparable heavy civil earthmoving. Each project must show no liquidated damages, defaults, or terminations. Supervisor and foreman key personnel require five years of heavy civil supervision experience. Bidders must comply with Surface Mining Control and Reclamation Act requirements, including Applicant/Violator System eligibility certification and Davis-Bacon wage determinations. The apparent low bidder must submit AML Contractor Information Forms within 24 hours of bid opening for OSMRE AVS review, which carries a 72-hour review timeline.

The bid bond is 5% of the bid on AIA Document A310-2010 or equivalent, issued by a surety authorized in Utah and listed on Treasury Circular 570. The awardee must furnish performance and payment bonds at 100% of the contract amount on AIA Document A312-2010 or equivalent within 14 calendar days of award, and no purchase order issues until they are received. Insurance requires commercial general liability of $1 million per occurrence and $3 million aggregate, commercial auto liability of $1 million per occurrence, and workers' compensation at statutory limits. Primes of $250,000 or more must submit a binding list of first-tier subcontractors with amounts exceeding $25,000. Any exceptions to standard terms cause rejection. Questions are submitted through the U3P portal, which also posts addenda and answered questions.
