About this opportunity
The Utah Department of Government Operations, Division of Purchasing and General Services is publishing a notice of intent to award Contract 246400 Amendment 1 without engaging in a standard procurement process, with a public challenge period closing October 21, 2026. The amendment seeks to add $13,480 in funds for two Opex Falcon Scanner PCs as a replacement and technology upgrade.
The sole-source justification rests on the finding that Opex Falcon machines are developed, manufactured, and owned entirely by Opex Corporation, with no other vendors offering compatible PC controls for these systems. The equipment integrates into the Utah Department of Workforce Services Eligibility Services Division document imaging system and must remain compatible with existing applications and interfaces, including upgraded Windows software. The original Contract 246400 was awarded through ACWESPP (sole source) for maintenance, repair, and software updates with an original total of $183,333.88; this amendment increases the contract total to $196,813.88, representing a 7.3 percent increase.
The procurement is subject to Utah Code 63G-27 et seq., requiring certification that vendors are not engaged in economic boycotts or boycotts of the State of Israel and agree to refrain from such boycotts during the contract term.
Interested vendors may contest the sole-source determination by submitting detailed documentation to the Division of Purchasing (not the Conducting Procurement Unit) demonstrating alternative competing sources capable of providing comparable or equivalent equipment meeting the same specifications, or offering lower transitional costs. A redacted quote and supporting justification documentation are attached to the notice. Vendors submitting proprietary information may claim business confidentiality under Utah GRAMA provisions 63G-2-305 and 63G-2-309 by filing both redacted and non-redacted versions of proposals with the Government Records Ombudsman.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
