About this opportunity

The Utah Department of Workforce Services (DWS) is seeking to extend an existing contract with LexisNexis for fraud prevention services through the Division of Purchasing, specifically for the Unemployment Insurance Division. This procurement is being conducted as a non-competitive contract extension under Contract 216120, Amendment 3, which allows for continuation of services through January 31, 2026. The contract originally covered fraud prevention technology and services, with the current amendment providing an additional 30-day extension to allow for completion of negotiations on a new cooperative contract (Purch25-3420 SCC RFP). The procurement is being processed through a Notice of Intent to Award Without Engaging in a Standard Procurement Process, justified by potential service interruption risks and ongoing contract negotiations. The key deliverables include continued access to fraud prevention technologies and services critical to the Unemployment Insurance Division's operational needs. The procurement documents indicate a due date of December 19, 2025, for any potential challenges to the non-competitive award process.

The procurement does not explicitly indicate specific set-aside designations or restrictions on responding organizations. The incumbent vendor is LexisNexis, which has been providing fraud prevention services under the existing contract. The contract total has incrementally increased from an original $395,000 to $415,000, and is now proposed to increase to $432,500, representing a 9.49 percent total increase from the original contract value. The estimated value of this specific procurement action is $17,500, with no associated freight costs. The contract extension is predicated on continuing existing fraud prevention technology infrastructure without disruption, suggesting a technology-specific procurement that requires maintaining current operational capabilities. The amendment includes anti-boycott provisions requiring contractors to certify compliance with Utah Code 63G-27, confirming they are not engaged in economic boycotts. Additional funding may be added to the contract if the legislature provides supplemental appropriations for the identified scope of work.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
