About this opportunity
The Utah Department of Government Operations, Division of Purchasing and General Services is publishing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process to Silver Kite Community Arts Consulting, LLC on behalf of the Department of Health and Human Services, Division of Licensing and Compliance, with a public notice period ending September 22, 2026. This is a sole-source award under Utah Code Section 63G-6a-802(1)(c) based on the Centers for Medicare & Medicaid Services having specifically designated Silver Kite Community Arts Consulting, LLC as the required service provider.
The scope is quality enhancement services for Medicare and Medicaid-certified long-term care facilities funded through Community Medicaid Program (CMP) grant dollars. The estimated contract value is $110,000.00 with no freight charges. The contract structure will result in either an agency contract or purchase order; the specific term and renewal options are not indicated.
Interested vendors may challenge this non-competitive award during the public notice period by submitting documentation demonstrating that alternative sources exist, that their firm can provide comparable or better services meeting or exceeding specifications, or cost comparisons related to transitional expenses. If valid challenges are received, the Division of Purchasing may elect to pursue a standard competitive procurement process, though exceptions apply if the justification rests on transitional costs or impracticability. All vendors must certify compliance with Utah Code 63G-27 et seq. regarding economic boycotts and boycotts of the State of Israel as a condition of contracting with the state. No action is required from vendors who agree with the non-competitive award determination.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
