About this opportunity

The City of Toledo Division of Purchases and Supplies is soliciting bids for replacement of a chemical feed boiler system in Lucas County, Ohio, with bids due November 17, 2026. A Project Labor Agreement applies: all contractors and subcontractors of any tier must execute a Letter of Assent, and the successful bidder must hold a pre-job conference with the Northwestern Ohio Building and Construction Trades Council (NWOBTC) within fifteen days of bid award notification. The agreement text covers dedicated off-site fabrication, assembly, insulation, and modules, while the City's PLA fact sheet states the agreement does not impact manufacturing and fabrication work. The fact sheet also states that Toledo Municipal Code requires 15 percent minority business enterprise participation for construction projects and 21 percent for HUD-assisted projects, and that the PLA does not override this requirement.

Each bid must include project paperwork, line items priced to two decimal places with one price per line, a bid guaranty, and a signed contract, all submitted through the PlanetBids portal, which issues email confirmation of completed submissions. The bid guaranty is 2.5 percent of the bid for bids of $75,000 or less, with a minimum of $40 and a maximum of $1,800, and 5 percent for bids above $75,000, with a maximum of $200,000. The guaranty may be a bid bond or a cashier's or official check payable to "City of Toledo," and personal and company checks are not accepted. Bids without a guaranty are non-responsive. A performance bond and PLA may be required upon award recommendation under Toledo Municipal Code sections 187.28 and 187.12.

The contract takes effect upon the Mayor's signature, continues until obligations are performed, and does not exceed one year; the template specifies no renewal options. The warranty runs at least one year from delivery. Payment is due within thirty calendar days of acceptance or receipt of a proper invoice, whichever is later. Liquidated damages are one percent of the order value or $250 per day, whichever is less, for each day a default remains uncured.

Living wage requirements under Toledo Municipal Code Chapter 187 apply to contracts over $10,000 and to contractors with 25 or more employees. Prevailing wage rates set by the Ohio Department of Commerce for Lucas County apply under Ohio Revised Code Chapter 4115, with certified payroll submitted electronically to contractcompliance@toledo.oh.gov within two weeks of project start and weekly thereafter. Contracts over $100,000 require general liability coverage of $2,000,000 products-completed operations aggregate and $1,000,000 per occurrence, auto liability of $1,000,000, and a $5,000,000 umbrella, with the City named as additional insured. Contractors working within Toledo city limits must register under Toledo Municipal Code Section 798.01, which carries a 2.5 percent tax rate and a $250 registration deposit. Contracts over $10,000 also require a child support affidavit covering owners or shareholders with 25 percent or greater vested interest.

Vendors must submit City paperwork once for all contracts, annual paperwork once per calendar year (including the W-9, certificate of insurance, workers' compensation certificate, EEO compliance, debarment certification, and living wage affidavit updated by February 1), and project paperwork with each bid. For a company's first bid on or after March 13, 2026, all three tiers are required. Questions go to pursupplies@toledo.oh.gov.
