About this file

This document is a Project Labor Agreements Fact Sheet issued by the City of Toledo, Ohio, providing guidance on labor agreement requirements for construction projects. The fact sheet applies to all construction projects funded by the City of Toledo or other funding sources that do not exclude Project Labor Agreements, with a threshold of $100,000 or greater. Project Labor Agreements apply to all contractors and subcontractors performing construction work on-site or adjacent to the worksite. The execution timeline requires a pre-job conference to be held within fifteen days of bid award notification between the successful bidder and the Northwest Ohio Building and Construction Trades Council (NWOBTC), with an executed Project Labor Agreement to be delivered to the Division of Purchases and Supplies within fifteen working days from the pre-job conference. The executed agreement must be signed by both the lead contractor and the Executive Secretary of NWOBTC to be deemed valid. No exemptions from the pre-job meeting are granted, even for companies already signatory to collective bargaining agreements.

The fact sheet clarifies that Project Labor Agreements do not affect the City's Minority Business Enterprise Program or override any requirements of the Toledo Municipal Code, which mandates 15 percent minority business enterprise participation for construction projects and 21 percent for HUD-assisted projects. Wages and fringe benefits must be paid according to applicable local collective bargaining agreements. The agreement prohibits strikes, lockouts, slowdowns, picketing, and work stoppages of any nature by the union and its members. The document does not impact manufacturing and fabrication work. Grievances and disputes are addressed through Article VI of the Project Labor Agreement. The fact sheet provides essential procedural information for bidders preparing to submit on the related Chemical Feed Boiler Replacement project.
