About this opportunity
The City of Midland, Texas is soliciting competitive sealed bids for the construction of two auxiliary football/soccer fields (Fields 5 & 6) at the Scharbauer Sports Complex located at 5514 Champions Drive. This Request for Bid (RFB) encompasses comprehensive construction services including site preparation, demolition of existing infrastructure, grading, drainage system installation, utility infrastructure (water, wastewater, storm drainage, electrical, and irrigation), parking lot development with 227 total spaces (221 standard and 6 handicapped), concrete flatwork and paving, synthetic turf field installation, ornamental fencing, landscape improvements, and all associated site amenities. The bid schedule contains 19 line items encompassing general conditions and site mobilization, demolition work (curb removal at 1,588 linear feet, flatwork removal at 4,149 square feet, roadway demolition at 6,790 square yards, and removal of 3 trees), site development and parking earthwork covering 328,725 square feet, storm and utility drainage systems, parking lot improvements including 2,055 linear feet of curb and gutter, asphalt paving at 85,687 square feet, concrete flatwork at 20,900 square feet, ornamental fencing at 1,575 linear feet, entrance gates, and landscaping and irrigation systems. Qualified bidders must possess appropriate licensing and bonding capability, carry workers' compensation insurance as required by Texas State Statute, maintain commercial general liability insurance ($1,000,000 per person/$1,000,000 per occurrence for personal injury; $500,000 per occurrence for property damage), business automobile liability ($250,000 combined single limit), and employers' liability ($500,000 per accident). For contracts exceeding $50,000, bidders must provide a Performance and Payment Bond equal to 100% of the contract price and a 5% bid bond with the proposal. The project requires contractor responsibility for all permits, surveying, materials testing, utility coordination with AEP Texas (Martin Valdes, 956-283-2596), traffic control, trench safety systems, dewatering, tree root protection based on diameter specifications, and comprehensive erosion control and storm water pollution prevention planning. A pre-bid meeting is scheduled for May 6, 2026, at 10:00 AM at the Diamond Club at Momentum Bank Ballpark, with sealed bids due May 20, 2026, at 2:00 PM through Bonfire; late submissions will not be accepted. The City of Midland will award the contract to either the lowest responsible bidder or the bidder offering the best value as determined under Texas Local Government Code Section 252.043, with the selected contractor required to execute the contract without modifications within 21 days of transmittal and commence work no later than 10 days after receipt of written release to proceed, with work completion required within a City-specified number of calendar days subject to liquidated damages of $500 per day for schedule failures.
The City of Midland's local preference policy, authorized under Texas Local Government Code 271.9051, permits awarding contracts to local bidders whose principal place of business is within city limits if their bid falls within five percent of the lowest bid received and the City Council determines the local bidder offers the best combination of price and economic development benefits; eligible bidders must complete and submit the Affidavit of Eligibility form to Erika Martinez, Purchasing Manager, prior to bid submission. All bidders must complete and submit required compliance documents including the Conflict of Interest Questionnaire (Form CIQ) as required by Texas Local Government Code Chapter 176, the Non-Collusion Statement certifying independent bid development without collusion with competitors, and the Notice to Bidders acknowledgment confirming compliance with ethics requirements under Texas Government Code Section 2252.908. Owner-furnished and owner-installed items include scoreboards, Musco Sports Lighting systems, shade structures, bleacher seating, a prefabricated restroom and concessions building, and the synthetic turf system, which will be procured by the City separately through a cooperative agreement; the general contractor will be responsible for site preparation and field preparation to receive these owner-supplied items. All iron and steel products used must be produced in the United States in accordance with applicable Government Code requirements. The project documents do not identify any incumbent contractors or current service providers requiring transition or integration, nor do they specify a total project budget or award value; however, bidders should note that contracts exceeding $50,000 trigger enhanced bonding and insurance requirements, and the project encompasses substantial civil, electrical, and utility infrastructure work suggesting a significant capital investment. Contractors failing to timely file required conflict of interest questionnaires or submitting false information face potential misdemeanor charges and one-year prohibitions from future City bidding opportunities, and all vendors must comply with a 120-day notice requirement for alleged contract breach damages or forfeit claims in perpetuity.
