About this opportunity
The National Institute of Standards and Technology (NIST) has published a Special Notice announcing its intent to award a sole source contract to JEOL USA, INC. for the disassembly and decommissioning of a JEM3010 transmission electron microscope located at the NIST Gaithersburg Campus in Maryland. The agency is utilizing the sole source authority under FAR 13.106-1(b)(1) because JEOL USA is the only authorized service provider with proprietary rights and access to the specialized technical data required to safely perform this work. The contract will be structured as a firm fixed-price purchase order under NAICS code 811210 for Electronic and Precision Equipment Repair and Maintenance services. NIST has determined that JEOL USA is the only reasonably available source capable of fulfilling these specialized requirements.
The primary purpose of this notice is to inform the contracting community of NIST's intention to proceed with sole source procurement while providing an opportunity for other potentially capable parties to demonstrate their qualifications. Interested contractors who believe they can meet all requirements must submit detailed capability statements by 10:00 AM EST on August 8, 2025, via email to the designated government point of contact. No formal solicitation package will be issued, and this notice does not constitute a request for competitive quotations. Contractors must provide sufficient detail in their capability statements to allow NIST to determine their ability to safely disassemble and decommission the specialized electron microscope equipment. The government retains sole discretion in determining whether to proceed with competitive procurement based on any responses received, and all information submitted will be evaluated only for the purpose of assessing whether a competitive acquisition should be conducted.
Notice text
The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with JEOL USA, INC., 11 Dearborn Road, Peabody, MA 01960-3823, to disassemble and decommission an existing JEM3010 transmission electron microscope (TEM) instrument located at the NIST Gaithersburg Campus in Gaithersburg, MD.
The sole source justification is based on the following:
The required disassembly and decommission of the JEM3010 TEM can only be completed by JEOL USA, Inc. as JEOL Inc. does not have any authorized service providers that can perform the disassembly and decommission or that have access to proprietary data for this instrument. JEOL is the only authorized service provider who can safely disassemble and decommission the JEM3010 TEM, since they have proprietary rights to this microscope.
Given these facts, JEOL USA Inc. is the only reasonably available source to fulfill the requirement. The resulting purchase order will be a Firm Fixed-Price purchase order. The NAICS Code is 811210 — Electronic and Precision Equipment Repair and Maintenance, with a business size standard of $34.0M.
No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. The Capability Statement must contain material in sufficient detail to allow NIST to determine if the party can meet all the requirements. The government will consider responses received by 10:00 AM EST on August 8, 2025. Responses must be submitted via email to the Government point of contact listed below.
A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
