About this opportunity
The Defense Logistics Agency (DLA) Energy issued a Justification and Approval for other than full and open competition to procure 19,320,000 U.S. gallons of F76 Naval Distillate fuel from Valero Marketing and Supply Company under contract modification SPE602-25-D-0475. The procurement was justified under the unusual and compelling urgency exception due to Defense Fuel Supply Point inventory reserves reaching minimum control limits, requiring expedited replenishment to meet critical military fuel demands. Valero was determined to be the sole capable supplier able to deliver the required volume within the compressed timeframe from March 18, 2026 to April 30, 2026, as no other vendors could refine and deliver the quantity by the required delivery date, and Valero had the fuel already positioned for loading. The unit price was deemed fair and reasonable through comparison to historical pricing and existing contract rates under the Inland/East/Gulf Coast Bulk Petroleum Products solicitation, with the new price only 3% higher than the prevailing contract rate. While the specific award value is redacted in the justification document, the contract represents a substantial fuel procurement addition to support Department of War operations during a critical supply shortage period.
Notice text
Defense Logistics Agency (DLA) Energy is the Integrated Material Manager (IMM) and
contracting activity for petroleum products and services for the Department of War (DoW).
This Justification and Approval (J&A) is for the acquisition of designated petroleum products
on an other than full and open competition basis due to unusual and compelling urgency, in
accordance with (IAW) Federal Acquisition Regulation (FAR) 6.104-1(a)(1). At the time of
the requirement, inventory fuel reserve conditions at Defense Fuel Supply Point (DFSP)
had reached their minimum control limits. The modification of the contract was
required to receive the requested amount of fuel by the Required Delivery Date (RDD). This
J&A authorizes the procurement of 19,320,000 U.S. gallons (USG) of Fuel, Naval Distillate
(F76) from Valero Marketing and Supply Co. (Valero). The purchase is in
addition to the Inland/East/Gulf Coast (IEG) Bulk Petroleum Products solicitation SPE602-24-
R-0709 requirement of F76. The period of performance is from March 18, 2026 to April 30, 2026.
Awarded contract SPE60225D0475 to unknown vendor for unknown amount on 2025-04-08.
