About this opportunity
The Department of Veterans Affairs, specifically the Veterans Integrated Service Network 2, has issued a Special Notice of Intent to award a sole source, firm-fixed price contract for medical equipment at the Buffalo VA Medical Center. The contract is for fifteen (15) Nihon Kohden brand NKV-330 Ventilators and fifteen (15) Nurse Call Cables, to be procured from After Action Medical and Dental Supply, LLC. Market research conducted by the Respiratory Therapy department determined that only the Nihon Kohden NKV-330 Ventilators meet their specific technical requirements. The procurement will be conducted under the authority of 41 U.S.C. 3304(a)(5) and 38 U.S.C. 8127(b), utilizing the North American Industry Classification System (NAICS) code 334510 for Electromedical and Electrotherapeutic Apparatus Manufacturing. Nihon Kohden has confirmed that After Action Medical and Dental Supply is their exclusive authorized distributor for these products.
The purpose of this Special Notice is to provide transparency about the intended sole source procurement and offer an opportunity for other vendors to demonstrate their capability to meet the government's requirements. Interested vendors are invited to submit a capability statement to jonathan.kilgore@va.gov no later than April 28, 2025, at 12:00 PM Eastern Standard Time. The capability statement must include the company name, Unique Entity Identifier (UEI) Number, Socioeconomic Category, and a brief description of the company's ability to provide the specified items. While the government acknowledges After Action Medical and Dental Supply as the primary vendor, they will review any submitted capability statements to potentially reconsider the sole source determination. Notably, After Action Medical and Dental Supply is a certified Service-Disabled Veteran-Owned Small Business (SDVOSB), which aligns with the VA's commitment to supporting veteran-owned businesses. The final decision on competitive procurement remains solely at the government's discretion, and simply responding as an interested party does not guarantee consideration as a potential source.

Notice of Intent
This is a Notice of Intent published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This Notice of Intent is for a proposed award of a sole source, firm-fixed price contract under the authority of 41 U.S.C. 3304(a)(5), 38 U.S.C. 8127(b), as implemented by FAR 6.302-5 Authorized or Required by Statute. It is not a request for competitive quotes.
The Department of Veterans Affairs, Network Contracting Office 02 intends to award a sole source, firm-fixed price contract to After Action Medical and Dental Supply, LLC for fifteen (15) Nihon Kohden brand NKV-330 Ventilators and fifteen (15) Nurse Call Cables. Members of the Respiratory Therapy department at the Buffalo VA Medical Center identified and evaluated several ventilator systems as part of market research efforts and determined that only the Nihon Kohden brand NKV-330 Ventilators had the required salient characteristics. Nihon Kohden is the original equipment manufacturer, and they have confirmed that After Action Medical and Dental Supply is the only vendor authorized to distribute their products. The North American Industry Classification System (NAICS) code for this requirement is 334510 and the product code is 6515.
While this synopsis does not constitute a solicitation, interested vendors may identify their interest and capability to satisfy the requirement. Telephone calls will not be accepted. The capability statement should include Company Name, UEI Number, Socioeconomic Category, and a brief description of your ability to provide these items. Simply responding as an interested party does not constitute your company as a source. Offeror must provide the above requested information. Such documentation will be reviewed solely for the purpose of determining whether or not to conduct the procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government
