About this file

This is a Worker Protection and Investment Certification Form (BOP-2201) published by the Commonwealth of Pennsylvania on February 4, 2022, pursuant to Executive Order 2021-06. The form requires contractors and grantees doing business with the Commonwealth to certify compliance with Pennsylvania's labor and workplace safety laws, including the Unemployment Compensation Law, Workers' Compensation Law, and thirteen specific state labor laws such as the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, Equal Pay Law, and others related to workplace safety, wage payments, and worker protections. The certification must be signed by an authorized official who confirms ongoing compliance and agrees to report any changes in compliance status immediately to the purchasing agency.

The form establishes legal consequences for providing false certifications, including contract termination and three-year ineligibility to bid on Commonwealth contracts under Pennsylvania law. The certification is subject to penalties under Pennsylvania Code Section 4904 for unsworn falsification to authorities, and the Commonwealth uses this requirement to ensure all contractors maintain safe work environments and comply with state labor protections as mandated by the executive order.
